HomeMy WebLinkAboutOrdinance #1032 ORDINANCE NO. 10 3 2 AN ORDINANCE ESTABLISHING CHAPTER 18, TITLE 1 OF THE CANTON MUNICIPAL CODE RELATING TO THE PURCHASE OF MUNICIPAL SUPPLIES, EQUIPMENT, VEHICLES, AND OTHER ITEMS OF PERSONAL PROPERTY THROUGH A COMPETITIVE BIDDING PROCESS AFTER ADVERTISEMENT. V~fi~RFAS, the Canton City Council has determined that it is necessary and in the best interest of the City of Canton to purchase major acquisitions of supplies, equipment, vehicles, and other items of personal property through a competitive bidding process after advertisement. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CAN'T'ON, Fulton County, Illinois as follows: 1. That Chapter 18, Title 1 of the Canton Municipal Code entitled, "Municipal Purchases" is hereby established to read as follows: "1-18-1: PURCHASE ORDERS AND CONTRACTS - COMPETITIVE BIDS: Except as otherwise herein provided, all purchase orders, contracts, or agreements of whatever nature, for the purchase, lease, or sale of per- sonal property, materials, equipment, or supplies, involving amounts in excess of $5,x00.00, made by or on behalf of the City of Canton, shall be let by free and open competitive bidding after advertisement, to the lowest responsible bidder. 1-18-2: PURCHASE ORDERS AND CONTRACTS - LESS THAN ~.~,000.00. All purchase orders, contracts, or agreements, as defined above, which shall involve amounts of $S,Z100.00, or less, shall be let in the manner prescribed above whenever practicable, except that such purchase orders, contracts, or agreements may be let in the open market in a manner calculated to insure the best interests of the public, after solicitation of bids by mail, telephone, or otherwise. 1-18-3: EXCEPTIONS: Contracts which by their nature are not adapted to award by competitive bidding, contracts for supplies, mater- ials, parts, or equipment which are available from a single source, con- tracts for utility service, and contracts let in the case of an emergency (so declared by the Corporate Authorities), shall not be subject to the competitive bidding requirements of this Ordinance. 1-18-4: WAIVER OF REQUIRhfi~'I'S: The Corporate Authorities of the City of Canton may, in any given instance, by a 2/3 vote thereof, waive the competitive bidding requirements of this Ordinance when such waiver clearly appears to be in the public interest. 1-18-5: ADVERTISEMENT FOR BIDS - DEPOSITS: All proposals to award purchase orders, contracts, or agreements in excess of $~,J00.00 shall be published at least once in a secular English language newspaper (daily or weekly) of general circulation throughout the City of Canton with such publication to be not less than ten (10) consecutive calendar days in advance of the date announced for the receiving of bids. Advertisements for bids shall describe the character of the proposed purchase order, contract, or agreement in sufficient detail to enable the bidders thereon to know what their obligations will be, either in the advertisement itself, or by reference to detailed plans and specifications on file at the time of the publication of the first announcement. Such advertisement shall also state the date, time, and place assigned for the opening of bids, and no bids shall be received subsequent to a time indicated in the announcement. The Canton City Council may extend the time for the opening of such bids by publication as aforesaid to a time not more than two (2) regular City Council meetings subsequent to the date originally announced for the opening of bids. Bids may, as appropriate, be required to be accompanied by a cashier's check of certified check, as a deposit of good faith, in an amount not to exceed l00 of the total bid amount. 1-18-6: BID SPECIFICATIONS: All bid specifications shall state that the Canton City Council reserves the right to alter or amend bid specifications without notice, to withdraw the bid specifications, and to reject any and all bids without assignment of reason therefor.. Further, all bid specifications shall provide that, as a condition to the making of any bid, the bidder and any person claiming through the bidder irrevocably waives any claim for damages or out-of-pocket expenses caused by the City of Canton's alteration or amendment of bid specifica- tion, withdrawal of bid specifications, or rejection of bids. 1-18-7: OPENING OF BIDS: All bids shall be opened publically by an officer or employee of the City of Canton at a date, time and place set by the Canton City Council (or, by a Committee thereof), which such date, time, and place of the public opening shall be set forth in the advertisement for bids. 1-18-8: RESPONSIBILITY OF BIDDERS - DETERMINATION: In determining the responsibility of bidders, the Canton City Council may take into account other factors in addition to the bidder's financial responsibility, such as past records of transactions with the bidder, experience, adequacy of equipment, ability to complete performance within a specified time limit, and other pertinent considerations. 1-18-9: ASSIGNMENT OF CONTRACTS: No contract awarded to the lowest respon- sible bidder shall be assignable or sublet by the successful bidder without the prior written consent of the Canton City Council. In no event shall a contract or any part thereof be assigned br sublet to a bidder who has been declared not to be a responsible bidder." 2. 'T'hat this Ordinance shall be in full force and effect immediately after its passage by the City Council of the City of Canton, Fulton County, Illinois, and approval by the Mayor thereof.
