DATED AT CANTON, ILLINOIS, THIS 1 •_ D A • January 2021 Diana Payer:ck, M C, City Clerk Seal City of Canton, Illinois ORDINANCE NO. 4210 AN ORDINANCE APPROVING THE PURCHASE OF A BACKUP GENERATOR FOR THE CITY OF CANTON FIRE DEPARTMENT WHEREAS,the City of Canton, Fulton County, Illinois ("City"), is a non-home rule unit of government; WHEREAS, the City is in immediate and emergent need of a backup generator at for the City's Fire Department to ultimately be used for public purposes; WHEREAS, Section 11-61-3 of the Illinois Municipal Code (65 ILCS 5/11-61-3) provides, in part: The corporate authorities of each municipality having a population of less than 1,000,000 inhabitants shall have the express power to purchase or lease either real estate or personal property for public purposes through contracts which provide for the consideration for such purchase or lease to be paid through installments to be made at stated intervals during a certain period of time, but, in no case, shall such contracts provide for the consideration to be paid during a period of time in excess of 20 years nor shall such contracts provide for the payment of interest at a rate of more than that permitted in"An Act to authorize public corporations to issue bonds, other evidences of indebtedness and tax anticipation warrants subject to interest rate limitations set forth therein", approved May 26, 1970, as amended.1 The indebtedness incurred under this Section when aggregated with existing indebtedness may not exceed the debt limits provided in Division 5 of Article 8 of this Code; WHEREAS, Section 8-9-1 of the Illinois Municipal Code (65 ILCS 5/8-9-1 provides, in part,that a contract for a public improvement which is not to be paid for in whole or part by special assessment or special taxation, when the expense will exceed $25,000 may be constructed by a contract entered into without advertising for bids, if authorized by a vote of two-thirds of the aldermen then holding office; WHEREAS,the City Council finds it to be clearly in the public's interest to proceed with the emergency purchase of the backup generator and has agreed by at least a vote of two-thirds (2/3)to waive competitive bidding requirements; WHEREAS, the City Council of the City of Canton has determined that it is necessary and in the best interest to purchase a new backup generator for the City of Canton and to have the same installed by Quick Electric, pursuant to their bid attached hereto as "Exhibit A." NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND THE CITY COUNCIL OF THE CITY OF CANTON, FULTON COUNTY, ILLINOIS AS FOLLOWS: 1. The City of Canton hereby finds as fact the recitals set forth above and are incorporated herein as though fully set forth; 2. The competitive bidding requirements set forth by Illinois law and the Canton Municipal Code are hereby waived; 3. The bid for the purchase and installation of the backup generator from Quick Electric, attached hereto as "Exhibit A,"and in the amount of$29,750.00, is hereby APPROVED; 4. The Mayor is hereby authorized to execute and deliver any and all purchase agreements, purchase orders, or other documents necessary to purchase the backup generator and all labor/services related to same; 5. The Treasurer is directed to use funds from the Fire Department's Capital Improvement Account for purposes of paying for the foregoing; 6. This Ordinance shall be in full force and effective immediately upon its passage by the City Council of the City of Canton and approval by the Mayor thereof PASSED AND APPROVED THIS 19th day of January, 2021. Box 49 Office 309.778.2000 445 Carter St Fax 309.778.2332 Fairview,IL 61432 www.quickelectric.net PROPOSAL 1-19-2021 City of Canton Dick Fairburn Project: Fire Dept Generator Replacement This proposal includes the following: • Provide and install Cummins 50kw 120/208-volt 3 phase diesel generator • Generator has a 48 hour fuel tank • Remove existing generator&gas line • Pour concrete pad for new generator • Rework existing conduit&wiring into new generator • Rework existing start circuit into existing transfer switches • Sales tax not included • Diesel fuel not included • The building will be without generator power for approximately 7 days. We have not figured installing a temporary generator during this outage. Total: $29,750 Add to provide a Cat generator in lieu of a Cummins: $6,000 (Cat has a 24 hour diesel tank) Thank you, Aaron Quick Quick Electrical Contractors, Inc Payments shall be made each thirty days as the work progresses. The entire amount of the contract shall be paid within thirty days of completion. Service and Finance Charges are applicable on past due accounts at the rate of 1 ''/_�%per month on amounts thirty days past due. Any alteration or deviation from the above specifications involving extra cost of material and/or labor will only be executed upon written orders for same, and will become an extra charge over the sum mentioned in this contract. All agreements must be made in writing. The contractor agrees to carry Workman's Compensation and Public Liability Insurance, also pay all Sales Taxes, and Unemployment Compensation Taxes upon the material and labor furnished under this contract, as required by the US&Illinois.
