WfIEREA.S, the Lake, Buildings and Grounds Committee has determined that it is necessary and in the best interest of the City of Canton to amend Title 8, Chapter 11, Section 2 of the Canton Municipal Code relating to boat license requirements at Lake Canton; and, Wf~REAS, the Canton City Council has made a similar determination. NO6~, Tf~REFORE, BE IT ORDAINID BY THE CITY COUNCIL OF THE CITY OF CANTON, Fulton County, Illinois as follows: 1. That Title 8, Chapter 11, Section 2 of the Canton Municipal Code is hereby amended to read as follows: "8-11-2: BOATING LICENSE REQUIRID: All persons operating boats or watercraft on Lake Canton shall first pay fees and obtain licenses as follows: Boat Motor Horsepower City Resident Non-Resident Daily *0 $6.00 $8.00 $?..00 Under 20 $12.00 $16.00 $4.00 39 thru 20 $40.00 $60.00 $8.00 85 thru 40 $50.00 $90.00 $12.00 *(Includes electric motors less than 1 HP.) All of the foregoing licenses are annual licenses running from January 1 through December 31 of the calendar year, excepting only the daily licenses as above set forth. The daily license rates apply equally to City residents and non-residents. The daily license is valid for not more than 24 consecutive hours from the time of its issuance. Limitations on License: 1. No license shall be issued for any boat or craft temporarily or permanently equipped with any motor or engine in excess of eighty- five (85) horsepower. 2. No license shall be issued for any boat or craft equipped with sleeping facilities. 3. All licenses shall be obtained by making application with the Cashier of the Water and Sewer Department at the City Building, 210 East Chestnut Street, Canton, Illinois, and each person applying for a license, as aforesaid, shall present evidence to show that the boat or craft is properly registered with the State, if required. 4. All owners and operators of boats and craft operated on Lake Canton shall carry liability and property damage insurance on each such boat or craft. 5. No boat or craft shall be powered by motor or engine between one hour after sunset and sunrise. ,~--` i ~ ,. 6. For purposes of this Section, City Resident is defined as all persons whose principal residence is within the corporate limits of the City of Canton; or, who awn Lake Lot Leases and who are current on lease payments and who are otherwise in full compliance with their lease provisions. The address as set forth on the appli- cant's driver's license shall be primae faciae proof of residence. 7. Citizens of the age of 65 or over will receive a twenty-five (25~) percent discount of the boat license fees. 8. Bass Clubs will receive a fifty (50~) percent discount of the daily rate license fee for the duration of the bass tournaments." 2. That Title 8, Chapter 11, Section 2 of the Canton Municipal Code here- tofore in force and effect is, to the extent inconsistent herewith, repealed. 3. That this Ordinance shall be in full force and effect ten days after its passage by the City Council of the City of Canton, Fulton County, Illinois, approval by the Mayor thereof, and publication in pamphlet form as provided by law.
