HomeMy WebLinkAboutOrdinance #1079ORDINANCE NO. 10.79 AN ORDINANCE AMENDING TITLE 3, CHAPTER 8, SECTIONS 9, 13, AND 20, RELATING TO CERTAIN INTOXICATING LIQUOR OFFENSES AND PENALTIES WHEREAS, the Canton City Council has determined that it is necessary and in the best interest of the City of Canton to amend Title 3, Chapter 8 of the Canton Municipal Code relating to intoxicating liquors. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF Illinois, as follows: CANTON, Fulton County, 1. That Title 3, Chapter 8, Section 9, Subsection (D) of the Canton Municipal Code is hereby amended to read as follows: ~~3_g_g(D) No person, prohibited therefrom by any applicable law of the State of Illinois shall purchase or have in his possession, actual, constructive, or, otherwise, within the Corporate limits of the City any alcholic beverage or liquor as defined in this Chapter." 2. That Title 3, Chapter 8, Section 13 of the Canton Municipal Code is hereby repealed. 3. That Title 3, Chapter 8, Section 20 of the Canton Municipal Code is hereby amended to read as follows: ".3-~-1U Yr;NHL'1'Y: ~xcepL a5 ULileiWl~C ~tVVtuvu i,a ~.aa~.a Section, any person who shall violate any of the provisions of this Chapter shall be punished by a fine of not less than twenty five dollars ($25.00) nor more than five hundred dollars ($500.00) for each such offense. Any person who shall violate any of the provisions of Section 9 of this Chapter shall be punished by a fine of not less than one hundred dollars ($100.00) nor more than five hundred dollars ($500.00) for each such offense. Any person who shall violate any of the provisions of Sections 17, 18, or 19 of this Chapter shall be punished by a fine of not less than one hundred dollars ($100.00) nor more than five hundred dollars ($500.00) for each such offense; a second or subsequent violation of any of the provisions of Sections 17, 18, or 19 of this Chapter shall be punished by a fine of not less than three hundred dollars ($300.00) nor more than five hundred dollars ($500.00). In addition to any fine provided for in this Section, any person who shall violate any provision of this Chapter shall be subject to the revocation provisions of Section 16 of this Chapter." 4. That this Ordinance shall be in full force and effect immed- iately upon its passage by the City Council of the City of Canton, Fulton County, Illinois, approval by the Mayor thereof, and publication in pamphlet form as provided by law. 5. PASSED by the City Council of the City of Canton, Fulton County, Illinois at a regular meeting this :.3rd day of September . 1985, upon a roll call vote as follows: AYES: Aldermen Chapman, may, Bohlen, Workman, Sarff, Falcone, Zilly, Kovachevich.
