AN ORDINANCE ANNEXING AND RE-ZONING CERTAIN TERRITORY TO THE CITY OF CANTON,
FULTON COUNTY, ILLINOIS.
WHEREAS, a Petition for Annexation and Re-Zoning, signed by the owners of
record, of the territory hereinafter described, was filed before the Planning
and Zoning Commission of the City of Canton, Illinois, requesting that said
territory be annexed to the City of Canton and re-zoned; and,
WHEREAS, the real estate which is the subject matter of the Petition is
legally described in Exhibit A, which is attached hereto and made a part of this
Ordinance by reference, and is located at West Hickory Limits, Canton, Illinois;
and,
WHEREAS, the real estate to be annexed and re-zoned is not within the
corporate limits of any municipality, but is contiguous to the City of Canton,
Illinois; and,
WHEREAS, there are two (2) electors residing in the territory to be annexed
and re-zoned; and,
WHEREAS, all petitions, documents and other necessary legal requirements
are in full compliance with the statutes of the State of Illinois; and,
WHEREAS, a public hearing was held before the Planning and Zoning Commission
of the City of Canton, Illinois on October 12, 1981, pursuant to proper notice
published in the Canton Daily Ledger; and,
WHEREAS, on October 12, 1981, the Planning and Zoning Commission of the City
of Canton, Illinois recommended. to the City Council of the City of Canton, Illinois
that the real estate described in Exhibit A be annexed to the City of Canton,
Illinois in an AG-1 (Agricultural) Zoning Classification, pursuant to the provisions
of Chapter 24; Section 7-1-8 of the Illinois Municipal Code; and,
WHEREAS, the real estate to be annexed and re-zoned has been zoned B-i (Business)
by the County of Fulton and should be annexed to the City of Canton in a CO-1
(Conservation) Zoning Classification; and,
WHEREAS, the highest and best use of the real estate to be annexed and re-zoned
is and CO-1 (Conservation) use; and,
WHEREAS, it is in the best interests of the City of Canton, Illinois that said
territory be annexed to the City of Canton, Illinois in an CO-1 (Conservation)
Zoning Classification.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CANTON,
ILLINOIS, AS FOLLOWS:
1. That the City Council. finds as facts the recitals hereinabove set forth.
2. That the territory described in Exhibit A, which is attached hereto and
made a part of this Ordinance by reference, be and the same is hereby annexed to
the City of Canton, Illinois.
3. That this property is hereby annexed in a.CO-1 (Conservation) Zoning
Classification.
4. That the Zoning Administrator of the City of Canton, Illinois is hereby
directed to make the appropriate changes to the zoning maps of the City of Canton
to reflect this annexation and re-zoning.
5. That the City Clerk of the City of Canton, Illinois is hereby directed to
record with the Recorder of Deeds of Fulton County and to file with the County
Clerk of Fulton County a certified copy of this Ordinance, together with an
accurate map of the annexed territory.
6. That this Ordinance shall be in full force and effect upon its passage
by the City Council of the City of Canton, Illinois and approval by the Mayor
thereof.

a roll call vote as follows:
AYES: Aldermen Chapman, May, Bohler, Workman, Sarff, Falcone,
Zilly, Kovachevich.
NAYS : None .
ABSENT: None.

of the North half of the Southwest Quater of Section 34,
Toamsh,ip 7 North, Range 4 East of th,e Fourth Principal Meridian.
Beginning at the intersection of Big Creek and the South line
of the Northwest Quarter of said Section 34 also being 416 feet
East of the Southwest corner of the Northwest Quarter of said
Section 34; thence. following acertain loop or arc in Big Creek
stream as existing on March 29, 1963; the chord of which is the
North line of the said Southwest Quarter, to a point on the said
North line of said Southwest Quarter of Section 34, said point also
being S 89° 36'32" W, 1825.87 feet fr_nm the center of said Section
34; thence Westerly along the South line of the Northwest Quarter
of Section 34, 38.71 feet; thence Northerly 652 feet to the South
right-of-,way line of Old West Oak Street (now ~); thence
continuing Northerly along the same line extended, across Lot 13
in T.N. Hornet's Addition, to the North right-of~way line of West
Hickory Street; thence Westexly along said North right-of-sway line
to the center of Big Creek; thence Southerly along the center line
of Big Creek to the point of beginning; said tract containing 6.710
acres, more or less and all lying in the West half of Section 34,
'T'ownship 7 North, Range 4 East of the Fourth Principal Meridian and
being in Fulton County in Illinois.
