ORDINANCE N0. 1059
AN ORDINANCE ABATING THE CITY OF CANTON'S PORTION OF REAL PROPERTY TAXES
ATTRIBUTABLE TO INCREASES IN ASSESSED VALUATION RESULTING FROM THE CONSTRUC-
TION OR REHABILITATION OF COMMERCIAL OR INDUSTRIAL FACILITIES WITHIN THE CITY
OF CANTON ENTERPRISE ZONE.
WHEREAS, certain real property set forth in Exhibit A hereto attached and
incorporated in this Oridnance by reference has previously been designated an
Enterprise Zone pursuant to the Enterprise Zone Act (I11. Rev. Stat. 1983, Ch.
67~, s601, et sequi); and,
WHEREAS, pursuant to the Enterprise Zone Act and authority of the Revenue
Act of 1939, as a~riended, the City of Canton may abate certain real property
taxes within the Enterprise Zone; and,
WHEREAS, the Canton City Council has determined that it is necessary and
in the best interest of the City of Canton to abate certain real property taxes
as hereinafter set forth.
NOW, THEREFORE, BE IT ORDAINED BX THE CITY COUNCIL OF THE CITY OF CANTON,
'~ulton County, Illinois, as follows:
1. That the foregoing recitals are hereby found to be fact and Exhibit A
hereto attached is herein fully incorporated by reference.
2. That 100% of the City of Canton''s share of real property taxes on real
property located in the Enterprise Zone as set forth in Exhibit A hereto are
hereby atSated for a period of five gears from and including January 1, 1985;
and, that 50% of the. City of Canton"'s share of real property taxes on real property
located in th.e Enterprise. Zone as set forth in Exhibit A hereto are hereby abated
far a period of five years from and including January 1, 19.90, subject, however,
to the following conditions:
a. Said abatement 5ha11 apply only to real property presently or hereafter
zoned business, commercial, or industrial by the City of Canton, or, to presently
existing valid nonconforming uses of any of the aforesaid character as long as such
nonconforming use shall continue to 6e used for business, commercial, or industrial
purposes;
b. The abatement provided for hereby shall apply only to the real property
taxes corresponding to an increase in assessed valuation after improvements (either
new construction or the renovation or rehabilitation of presently existing improve-
ments) have been duly assessed and said abatement shall not exceed the amount
attributable to the construction of the improvements and the renovation or rehabili-
tation of existing improvements;
c. The abatement herein provided for shall pertain only to those parcels
of real property (and improvements thereto) within the City of Canton and within
the Enterprise Zone as set forth in Exhibit A hereto attached and which have been
improved after the designation of the Enterprise Zone;
d. While the abatement herein provided for is in effect, the City of
Canton will continue to receive all real property taxes corresponding to the equalized
assessed valuation for the tax year immediately preceeding the commencement of the
construction, or renovation or rehabilitation;
e. The abatement herein provided for shall not be effective after
the termination of the Enterprise Zone.
3. That, to the extent inconsistent herewith, Ordinances Number 959 and
989 passed by the Canton City Council on or about, respectively, December 27,
1982 and September 6, 1983, are hereby amended.
4. That the Canton City Clerk is hereby directed to file certified copies
of this Ordinance with the Fulton County Clerk, the Fulton County Assessor, and
the Illinois Department of Commerce and Community Affairs immediately upon its
passage and approval.
5. That this Ordinance shall be in full force and effect immediately upon
its passage by the City Council of the City of Canton, Fulton County, Illinois,
approval by the Mayor thereof, and issuance of an amended certificate for the
Enterprise Zone approving this amended designating ordinance by the Illinois
Department of Commerce and Coirnrnanity Affairs in conformity with Section 5.4 of
the Illinois Enterprise Zone Act.
PASSED by the City Council of the City of Canton, Fulton County, Illinois at
a regular meeting this 16th day of April 1985 upon a roll call
vote as follows:
AYES: Aldermen Horr, May, Carl, Workman, Sarff, Hammond,
Kovachevich.
NAYS: None .
ABSENT: Alderman Savill.
