HomeMy WebLinkAboutOrdinance #1111ORDINANCE NO. 1 1 1 ~,_, AN ORDINANCE PROVIDING FOR AND REQUIRING THE SUBMISSION OF THE QUESTION OF LEVYING AN ANNUAL TAX AT THE RATE OF NOT TO EXC® .03~ OF THE VALUE, AS EQUALIZED OR ASSESSED BY THE DEPAl~IT~NT OF REVELWE, OF ALL THE TAXABLE PROPER'T'Y IN THE CITY OF CANTON FOR THEPURPOSE OF ACQUIRING, OPERATING AND MAINTAINING A CULTURAL CATER TO HOUSE THE CANTON MUSEUM. WHEREAS, the City Councul of the City of Canton, Fulton County, Illinois (the "City"), has determined that it is necessary and in the best interest of the City to sut~nit to the voters of the City the question of levying a direct annual tax on all taxable property in the City for the purpose of acquiring, operating and maintaining a cultural center to house the Canton MuseLUn; and, WHERF,AS, the sul~ti.ssion of such question is authorized and required by Chapter 24, Article 11, Division 45.1 of the Illinois Revised Statutes (1985). NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CANTON, Fulton County, Illinois, as follows: 1. That the foregoing recitals are hereby found to be fact. 2. That the question hereinafter set forth shall be sul~ni.tted to the voters of the City in accordance with the general election law at the general election to be held Tuesday, November 4, 1986, between the hours of 6:00 o'clock A.M. and 7:00 o'clock P.M. on said day (the "Election"). 3. That the Election shall be held in the voting precincts and at the polling places established by the County Board (the "County Board") of Fulton County, Illinois (the "County"), for voters of the City at said election. 4. That the County.Clerk of Fulton County, Illinois (the "County Clerk") shall give notice of the Election in accordance with the general election law by publishing notice thereof once in one or mere local, canarnuzity newspapers published in the City, and also once in a newspaper published in the County, the date of such publication of said notice to be not more than 30 nor less than 10 days prior to the date set for the Election. 5. That it is hereby found and determined that the Canton Daily Ledger is a local, community newspaper published and having general circulation in the City, as required by Sections 12-4 and 12-5 of the Election Code of the State of Illinois. 6. That said notice shall include the following: NOTICE IS HEREBY GIVII~I that at the general election to be held Tuesday, November 4, 1986, the following question will be suhanitted to the voters of the City of Canton, Fulton County, Illinois: Shall the corporate authorities of the City of Canton acquire, operate and maintain a cultural center to house the Canton Museum and levy annually a tax of not to exceed .03~ of the value, as equalized or assessed by the Depaxtrnent of Revenue, of all the taxable property in the City of Canton for such purpose? The polls at said election will be open at 6:00 o'clock A.M. and continue open until 7:00 o'clock P.M. of that day. Dated at Lewistown, Illinois, this day of , 1986. That the ballot to be used at the Election shall be in substantially the following form: (Face of Any Paper Ballot and Question Form for Voting Machine) OFFICIAL BALLOT QUESTION TO ACQUIRE, OPERATE AND MAINTAIN A CULTURAL CENTER 'I'O HOUSE THE CANTON MUSUEM AND LEVY ANNUALLY A TAX OF NOT TO EXCEID .03$ OF THE VALUE, AS EQUALIZED OR ASSESSID BY THE DEPAR'Ii~'lENT OF REVELQUE, OF ALL THE TAXABLE PROPERTY IN THE CITY OF CANTON FOR SUCH PURPOSE. (Back of Any Paper Ballot) Official ballot for voting on the question to acquire, operate and maintain a cultural center to house the Cantors Museum and levy annually a tax of not to exceed .03$ of the value, as equalized or assessed by the Department of Revenue, of all the taxable property in the City of Canton for such purpose. That the Election shall be held and conducted and the returns thereof duly canvassed, all in the manner and time as provided by the general election law. 9. That all ordinances, orders and resolutions and parts thereof in conflict herewith be and the same hereby are repealed,~and that this Ordinance:-shall be in full force and effect immediately upon its passage by the City Council of the City of Canton, Fulton County, Illinois and approval by the Mayor thereof. 10. That after the adoption hereof and not later than August 15, 1986, the City Clerk of the City of Canton, Fulton County, Illinois, shall certify a copy hereof to the County Clerk in order that the question set forth herein may be subanitted to the voters of the City at the Election. PASSID by the City Council of the City of Canton, Fulton County, Illinois at a regular meeting this 1st day of July , 1986, upon a roll call vote as follows: AYES: Aldermen Kovachevich, Zilly, Steck, Sarff, Workman, Kohler, May, Chapman.
