Home My WebLink AboutOrdinance #1099ORDINANCE NO . 10 9 9 AN ORDINANCE C~2ANTING A SPECIAL USE PERMIT TO THE FUL'TON COUNTY REHABILITATION CEN'T'ER EXCLUSIVE TO C01~90N ADDRESS OF 625 SOUTH FIFTH AVENUE, CANTON, ILLINOIS w~, the Fulton County Rehabilitation Center, anon-profit corporation, has petitioned for rezoning of certain real property located generally at 625 South Fifth Avenue in the City of canton, Illinois, or alternatively, for the issuance of a special use permit personal to the Fulton County Rehabilitation Center; and, WHEREAS, public hearing on said request was held on Monday, January 13, 1986 before the City of Canton Planning and Zoning Commission which Commission recom- mended to the Canton City Council the issuance of a special use permit pursuant to Section 3, Chapter 9, Title 10 of the Canton Municipal Code; and, WHEREAS, testimony adduced at the public hearing established that the Fulton County Rehabilitation Center is a non-profit corporation which was organized and which now exists to further a legitimate governmental purpose pursuant to authority of state statute administered through the County of Fulton; that the Fulton County Rehabilitation Center is funded, in part, by the imposition of a direct annual tax by the County of Fulton; and the, Fulton County Rehabilitation Center is subject t;o .and endeavors to comply with the Illinois Open Meetings Act; and, WHEREAS, testimony adduced at the hearing established that the Fulton County Rehabilitation Center operates a training center for disabled persons similiar to the schools, colleges, or private schools contenq~lated in paragraph (G) of Section 2, Chapter 9, Title 10 of the Canton Municipal Code; and, Wf~RFAS, testimony adduced at the .public hearing established that the proposed use by the Fulton County Rehabilitation Center of the premises at 625 South Fifth. Avenue in the City of Canton, Illinois is a governmental office or other governmental use within the meaning of subparagraph (RR) of Section 2, Chapter 9, Title 10 of the Canton Municipal Code; and, WI~REAS, testimony adduced at the public hearing established that the proposed operation of the Fulton County Rehabilitation Center at 625 South Fifth Avenue in the City of Canton, Illinois will b;e as a publicly awned building, public utility building, or service yard within the meaning of subparagraph (DD) of Section 2, Chapter 9, Title 10 of the Canton Municipal Code; and, WHEREAS, testimony adduced at the public hearing established that a portion of the proposed operation at address of 625 South Fifth Avenue in the City of Canton, Fulton County, Illinois will be a wholesale or jobbing business within the meaning of subparagraph (B)9 of Section 3, Chapter 9, Title 10 of the Canton Municipal Code, which wholesale or jobbing business is part of the training program implmented by the Fulton County Rehabilitation Center; and,.,, Wf~REP,S, all of the subject property at common address of 625 South Fifth Avenue, Canton, Illinois is presently zoned B-2, General Commercial District. NOW, THEREFI~RE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CANTON, Fulton County, Illinois, as follows: 1. That the Canton City Council hereby finds the foregoing recitals to be fact. 2. That the Canton City Council hereby accepts and approves the recc~¢nenda- tion of the City of Canton Planning and Zoning Commission with respect to the proposed use of the Fulton County Rehabilitation Center at conmon address of 625 South Fifth Avenue, Canton, Illinois. 3. That a special use exception permit for an open air wholesale or jobbing business is hereby issued to the Fulton County Rehabilitation Center, a non-profit corporation, which special use exception permit shall be personal to the Fulton County Rehabilitation Center only at address of 625 South Fifth Avenue, Canton, Illinois, and with respect to the following described real property: Lots 15, 16, 17, 18, 19, 23, 24, 25, 26 and 28 in Carl Marshall's Addition to the City of Canton, Fulton County, Illinois.: pursuant to. authority of Sectiorn:.3,Chapter 9, Title;~10 of the Canton Municipal Code. 4. That the special use exception permit hereby granted for an open air wholesale or jobbing business shall be subject to the following recguirements and conditions: a. That the permit is personal too the Fulton County Rehabilitation Center, a non-profit corporation, and is not assignable to the center's successors, or assigns. That any attempt to assign or transfer the permit by the Fulton County Rehabilitation Center shall, by operation of law, immediately void said permit. - --- -_ b. That the permit is subjectr .toy .the rec~ui:rez~enta=and_cQnditiorYS of subparagraph (B) of Section 3, Chapter 9, Title 10 of the Canton Municipal Code as the same is now promulgated or may hereafter be amended. c. That the permit hereby granted is effective only with. respect to the above described real property at common address of 625 South Fifth Avenue, Canton, Illinois. d. That the permit is specifically made subject to all other require- ments and conditions of Title 10 of the Canton Municipal Code, as well as all other provisions of the Canton Municipal Code, as the same is now promulgated or may hereafter be amended. e. That the permit is specifically made subject to all other federal, state, or local statutes, laws, ordinances, rules or regulations as the same may apply to the Fulton County Rehabilitation Center at address of 625 South Fifth Avenue, Canton, Illinois. f. That the open air business use for a wholesale or jobbing business authorized by this permit shall be operated in such a manner that: 1. The external, physical effects of the open air wholesale or jobbing operation hereby authorized are restricted to the area of the above described real property to be owned or controlled by the Fulton County Rehabilitation Center; and, 2. That the Fulton County Rehabilitation Center aperate the open air wholesale or jobbing operation in such a manner that it will not cause adverse effects on adjacent residen- tial or crcial property. 5. That this Ordinance shall be in full force and effect immediately upon its passage by the City Council of the City of Canton, Fulton County, Illinois, and approval by the Mayor thereof. 6. That the City Clerk shall certify a copy of this Ordinance to the Fulton County Rehabilitation Center in lieu of issuance of a separate permit.
