HomeMy WebLinkAboutResolution #1167RESOLUTION NO. 1 1 6 7 A RESOLUTION PROVIDING FOR AND REQUIRING THE SUBMISSION OF THE QUESTION OF THE CITY OF CANTON BECOMING A HOME RULE UNIT OF LOCAL G~ TO THE VOTERS OF THE CITY OF CANTON, ILLINOIS. WHEREAS, the City Council of the City of Canton, Fulton County, Illinois (the "City"), has determined that it is necessary and in the best interest of the City to sutniit to the voters of the City the question of the City of Canton, Illinois becoming a Hoge Rule unit of local government; and, Wf~REA.S, the submission of such question is authorized and required by Article VII, Section 6(a) of the 1970 Illinois Constitution; and, WHEREAS, the initiation of such question is provided for by Section 28-7, Chapter 46, Illinois Revised Statutes (1985). NOW, THEREFORE, BE IT RESOLVID BY THE CITY COUNCIL OF THE CITY OF CANTON, Fulton County, Illinois, as follows: 1. That the foregoing recitals are hereby found to be fact. 2. That the question hereinafter set forth shall be sukxnitted to the voters of the City in accordance with the general election law at the general election to be held Tuesday, November 4, 1986, between the hours of 6:00 o'clock A.M. aril 7:00 o'clock P.M. on said day (the "Election"). 3. That the election shall be held in the voting precincts and at the polling places established by the County Board (the "County Board") of Fulton County, Illinois (the "County"), for voters of the City at said election. 4. •1•nat the wunty (:lerJc of Fulton County, Illinois (the "County- C shall give notice of the Election in accordance with the general election law by publishing notice thereof once in one or more local, comnnznity newspapers publish- ed in the City, and also once in a newspaper published in the County, the date of such publication of said notice to be not more than 30 mor less than 10 days prior to the date set for the Election. 5. That it is hereby found and determined that the Canton Daily L~lger is a local, community newspaper published and having general circulation in the City, as required by Sections 12-4 and 12-5 of the Election Code of the State of Illinois. 6. That said notice shall include the following: NOTICE IS HEREBY GIVEN that at the. general election to be held Tuesday, November 4, 1986, the following question will be submitted to the voters of the City of Canton, Fulton County, Illinois: Shall the City of Canton, Illinois become a Home Rule unit of local government_,pursuant to Article VII, Section 6 (a) of the Illinois Constitution? Tlae polls at said election will be open. at 6:OO o'clock A.M, and continue open until 7:OO o'clock P.M. of that day._ Dated at Lewistown, Illinois, this day of 1986. County Clerk, Fulton County, Illinois 7. That the ballot to be used at the Election shall be in substantially the following form: (Face of Any. (INSTRUCTIONS TO VO'T'ERS: Mark a cross (X) in the space opposite the ward indicating the way you desire to vote.) That the Election shall be held and conducted and the returns thereof duly canvassed, all in the manner and time as provided by the general election law. 9. That the City Clerk shall, not later than October 10, 1986, file with the Secretary of State a certified stateement indicating when the referenduun will be held. Also, that the City Clerk shall, within 30 days after the referendtun, file with the Secretary of State a certified statement showing the results of the referendum and the resulting status of the City of Canton, Illinois as a hone rule unit or a non-hone rule unit of local government. 10. That the Canton City Council hereby finds that a referendum on the foregoing proposition has not been held in the 23-month period preceeding either this Resolution, or, preceeding the general election to be held November 4, 1986. 11. That all ordinances, orders and resolutions and parts thereof in conflict herewith be and the same hereby are repealed, and that this Resolution shall be in full force and effect immediately upon its passage by the City Council of the City of Canton, Fulton County, Illinois and approval by the Mayor thereof. 12.? That after the adoption hereof and not later than August 15, 1986, the City Clerk of the City of Canton, Fulton County, Illinois, shall certify a copy hereof to the County Clerk in order that the question set forth,. herein may be submitted to the voters of the City at the Election.
