AN ORDINANCE AMENDING THE CANTON CITY CODE
PERTAINING TO STRIP MINING
WHEREAS, Chapter 16 of the Canton City Code embraces the topic of mining coal by the
strip mining method in the watershed area of Lake Canton, and,
WHEREAS, all regulation of strip mining activities has been preempted by the State of
Illinois by the Surface Coal Mining Land Conservation and Reclamation Act (225 ILCS
720/1.01 et. seq.) which became effective on June 1, 1980, and which in turn, adopts
Federal law on the subject, and,
WHEREAS, Chapter 16 of the Canton City Code had been previously adopted, to wit,
June 25, 1970 but is now a nullity,
NOW THEREFORE, BE IT ORDAINED by the City Council of the City of Canton, Illinois as
follows:
1. Chapter 16 of the Canton City Code pertaining to regulation of and permit
required for strip mining be and the same is hereby repealed.
2. This ordinance shall be effective immediately upon passage and publication or
posting thereof as required by law.
3. Passed at a regular meeting of the Canton City Council by the vote shown and
on the date 2nd day of May, 2006.

NAYS: Schenck, Meade, GJest, Sarff.
