HomeMy WebLinkAboutOrdinance # 1864.1" • ~n ORDINANCE NO. 1864 AN ORDINANCE AMENDING TITLE 4, CHAPTER 1, TITLE 5, CHAPTER 2, AND TITLE 5, CHAPTER 6 OF THE CANTON MUNICIPAL CODE BY ADOPTING THE 2003 BUILDING CODES, INCLUDING THE APPENDIX CHAPTERS AND THE 2004 SUPPLEMENT. WHEREAS, it has been determined that it is necessary, desirable, and in the best interest of the City of Canton to amend Title 4, Chapter 1, Title 5, Chapter 2 and Title 5, Chapter 6 of the Canton Municipal Code; and, WHEREAS, by amending the Canton Municipal Code, the City of Canton hereby adopts guidelines known as the "Building Codes"; and, WHEREAS, the amending establishes minimum regulations governing the conditions and maintenance of all property, buildings and structures; provides the standards for supplied utilities and facilities and other physical items and conditions essential to ensure that structures are safe, sanitary and fit for occupation and use; and establishes the condemnation of buildings and structures unfit for human occupancy and use and the demolition of such structures; and WHEREAS, the Canton City Council has made a similar determination. 4 •` ~, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CANTON, Fulton County, Illinois, as follows: 1. That the Canton City Council finds the foregoing recitals to be fact. 2. That, accordingly, Titles 4-1-1, 5-2-12, 5-6-1 and 5-6-2 of the Canton Municipal Codes is hereby amended to read as follows: "4-1-1: CODES ADOPTED (A) Building Code: The following listed codes, along with all appendix chapters for all listed codes and the 2004 Supplement, are hereby adopted, collectively and individually, as the building codes for the City of Canton. The provisions of any supplement to the listed codes and the 2004 Supplement shall be included in any reference made to "the code", and shall have the same force and effect as the original code: 1. 2003 International Building Code 2. 2003 International Fire Code 3. 2003 International Residential Code 4. 2003 International Mechanical Code 5. 2003 International Plumbing Code & Illinois State Plumbing Code of 1998 6. 2003 International Private Sewage Disposal Code 7. 2003 International Fuel Gas Code 8. 2003 International Energy Conservation Code 9. 2003 International Property Maintenance Code 10. 2003 International Zoning Code 11. 2003 ICC Electrical Code 12. 2003 International Existing Building Code (B) Codes Adopted and Published: The various codes herein listed, the appendix chapters thereto and the 2004 supplement, as they now exist in book or printed form are hereby declared published for purposes of this Chapter and are permanently on file and available for public use, inspection and examination at the office of the Canton City Zoning Officer or Canton City Fire Chief. (C) Code Variances: Variances from specific provisions of the codes herein adopted may be permitted on appeal to the appropriate board of appeals appointed by the City Council. Should such board of appeals, after hearing, determine that a variance is necessary to alleviate undue hardship and will not adversely affect the health, safety and welfare of the occupant of the applicable building or of any other person, are hereby authorized to grant said variance. (D) Building Permit Fee Schedule: In accordance with Section 114.31.1, Fee Schedule, contained in the BOLA National Building Code, the following fee schedule has been adopted as the fee schedule for building permits, issued by the City of Canton: $ 1.00 to $ 500.00 $10.00 $ 501.00 to $ 2,000.00 $:10.00 for the first $500.00 plus $1.50 for each additional $100.00 or fraction thereof, to and including $2,000.00 $ 2,000.00 to $ 25,000.00 $32.50 for the first $2,000.00 plus $6.00 for each additional $1,000.00 or fraction thereof, to and including $25,000.00. $ 25,001.00 to $ 50,000.00 $170.50 for the first $25,000.00 plus $4.50 for each additional $1,000.00 or fraction thereof, to and including $50,000.00. $ 50,001.00 to $100,000.00 283.00 for the first $50,000.00 plus $3.00 for each additional $1,000.00 or fraction thereof, to including $100,000.00. a $100,001.00 and up $433.00 for the first $100,000 plus $2.50 for each additional $1,000 or fraction thereof." "5-2-12: INTERNATIONAL FIRE CODE APPLICATION: The city reemphasizes those provisions of the 2003 International Fire Code, the appendix chapters thereof and the 2004 Supplement pertaining to installation of combustion devises and other instrumentalities capable of initiating combustion by contact. The City has previously adopted the 2003 International Fire Code, along with the appendix chapters thereof and the 2004 Supplement, and said supplements shall have the same force and effect of the 2003 International Fire Code, and shall be included in any reference made to "the code". The Canton Fire Department shall have the authority to enforce the 2003 International Fire Code, its appendix chapters and the 2004 Supplement. The Fire Chief, or his designees, shall have the authority to issue a citation to the owner, operator, occupant or other person responsible for the condition which constitutes a violation of said code. Further, storage of combustible or flammable material shall be in accordance with the said code. Any person violating any 2003 International Fire Code provisions of this nature shall be fined not less than seventy-five dollars ($75.00) nor more than five hundred dollars ($500.00)." "5-6-1: CODE ADOPTED: The 2003 International Fire Code, the appendix chapters and the 2004 Supplement shall be, and the same is hereby adopted as the fire code of the City of Canton. 5-6-2 PERMIT FEES: (A) The Canton Fire Department shall issue annual permits pursuant to the International Fire Code, 2003 edition, the appendix chapters and the 2004 Supplement, hereafter called "code". The fee shall be paid to the City Treasurer. No permit is valid until the applicable fee, if any, is paid in full. (B) Other governmental entities, located within the corporate limits of the City of Canton, shall be exempt from the permit fees, but shall be required to obtain a permit for any of the applicable categories listed herein. (C) Permits for each individual category shall be required to be paid by the owner/occupant at a cost of $25.00 each, with a maximum of $100.00. The maximum of $100.00, annually, shall apply even if more than four (4) permits are required.
