HomeMy WebLinkAbout#4198 Approving The Purchase of A 2002 E-ONE Heavy Rescue Truck ORDINANCE NO. 4198 AN ORDINANCE APPROVING THE PURCHASE OF A 2002 E-ONE HEAVY RESCUE TRUCK WHEREAS,the City of Canton, Fulton County, Illinois ("City"), is a non-home rule unit of government; WHEREAS, Section 11-61-3 of the Illinois Municipal Code (65 ILCS 5/11-61-3) provides, in part: The corporate authorities of each municipality having a population of less than 1,000,000 inhabitants shall have the express power to purchase or lease either real estate or personal property for public purposes through contracts which provide for the consideration for such purchase or lease to be paid through .installments- to be made at stated intervals during a certain period of time, but, in no case, shall such contracts.provide for the consideration to be paid during a period of time in excess of 20 years nor��shall such contracts provide for the payment of interest at a rate of more than that permitted in "An Act to authorize public corporations to issue bonds, other evidences of indebtedness and tax anticipation warrants subject to interest rate limitations set forth therein'.', approved May 26, 1970, as' amended! The indebtedness incurred under this Section when aggregated with existing indebtedness may not exceed the debt limits. provided in Division 5 of Article 8 of this.Code; WHEREAS, the City of Canton currently uses two (2) different trailers for its hazardous materials equipment and the equipment for its Technical Rescue Team (TRT), which are both several years old and in need of replacement in the foreseeable future; WHEREAS, the,Public Safety Director has advised that the purchase of a.heavy rescue truck would allow the Canton Fire Department to store the hazardous materials equipment and TRT equipment in one (1)vehicle;, WHEREAS,the.City is in need of a new heavy rescue truck to use for public purposes; WHEREAS, the City Council of the City of Canton has determined that it is necessary and in the best interest to purchase a heavy rescue truck from the Sacramento Metropolitan Fire Department. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CANTON, FULTON COUNTY, ILLINOIS AS FOLLOWS: f. The Recitals set forth above, and all facts and statements contained therein, are found to be true-and correct and are hereby incorporated and adopted as part of this Ordinance. 2. The Mayor and/or Public Safety Director is hereby authorized to execute and deliver any and all purchase agreements, purchase orders, or other documents (collectively "purchase Page 1 of 3 contract") necessary to purchase a 2002 E-One Cyclone heavy rescue truck for a purchase price not to exceed $15,000.00 (not including taxes, title, or insurance, as applicable), plus applicable taxes, title, and insurance, provided the purchase contract thereof shall not exceed twenty (20) years; 3. The Mayor and/or Public Safety Director are hereby directed and authorized to incur up to Ten Thousand and No/100 Dollars ($10,000.00) for the purpose of transportation expenses for delivering the heavy rescue truck to the City; 4. The City Treasurer shall cause the payment for the heavy rescue truck and related transportation expenses to be paid from the account known as: Fire Dept Capital Imp Replacement GL Account# 001-00-11252. 5. This Ordinance shall be in full force and effective immediately upon its passage by the City Council of the City of Canton and approval by the Mayor thereof. PASSED AND APPROVED THIS 26`h day of June, 2020.
