HomeMy WebLinkAboutResolution #2050-ARESOLUTION NO. ~n~n~r, A RESOLUTION PERTAINING TO A SPECIAL USE PERMIT HELD BY HEALTH CARE AND RETIREMENT CORPORATION OF AMERICA WHEREAS, the Health Care and Retirement Corporation of America was previously issued a Special Use Permit issued by Ordinance on or about April 1, 1986 which is personal to the Health Care and Retirment Corporation of America; WHEREAS, the Canton City Council is informed that the Health Care and Retirement Corporation of America, as a financing tool, is entering into a limited partnership 'wherein a wholly owned subsidiary of Health Care And Retirement Corporation of America will be the general partner and wherein 85 per cent of the equity of the partnership will remain with Health Care and Retirement Corporation of America and wherein the management will .remain unchanged and in Health Care and Retirement Corporation; and, WHEREAS, inquiry has been made of the Canton City Council as to whether or not it was the intendment of the prohibition relating to said Special Use Permit that such permit be null and void in this specific situation. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CANTON, Fulton County, Illinois as follows: 1. That the Canton City Council hereby finds the foregoing recitals to be fact based upon representations made to the City of Canton by officers and employees of the Health Care and Retirement Corporation of America. 2. That it is the opinion of the Canton City Council that the Special Use Permit which issued to Health Care and Retirement Corporation of America by Ordinance on or about April 1, 1986 was not intended to become null and void with respect to the present restructuring. 3. The Canton City Council hereby further determines that it is the opinion of the Canton City Council that the intent of the aforesaid Ordinance would allow the restructuring as contemplated by Health Care And Retirement Corporation of America without any • amendment of said Special Use Permit. 4. That the City Clerk shall certify a copy of this Resolution to Health Care and Retirement Corporation of America. 5. That this Resolution shall be in full force and effect immediately upon its passage by the City Council of the City of Canton, Fulton County, Illinois and approval by the Mayor thereof. PASSED by the City Council of the City of Canton, Fulton County, Illinois at a regular meeting this 5th day of April, 1989, upon a roll call vote as follows: AYES: Aldermen Chapman, May, Bohler, Meade, Sarff, Steck, Zilly, NAYS: None.
