COUNTY OF FULTON ) CERTIFICATE I, Diana Pavley-Rock, certify that I am the duly elected City Clerk of the CITY OF CANTON, FULTON COUNTY, ILLINOIS. I further certify that on April 16, 2020 , the City Council of such municipality passed and approved Ordinance No 4188 entitled: AN ORDINANCE AMENDING TITLE 6, CHAPTER 8 (FAIR HOUSING) OF THE CITY CODE OF THE CITY OF CANTON, ILLINOIS. which proved by its terms that it should be published in pamphlet form. The pamphlet for Ordinance No. 4188 including the Ordinance and a cover sheet thereof, was prepared, and a copy of such Ordinance was posted at City Hall, 2 North Main Street Canton IL, commencing on April 16,2020 , and continuing for at least ten days thereafter. Copies of such Ordinance were also available for public inspection upon request in the Office of the City Clerk. DATED AT CANTON, ILLINOIS, THIS 1 D Y A ril 2020 Diana Pavle o , CMC, City Clerk Seal City of Canton, Illinois ORDINANCE NO. 4188 AN ORDINANCE AMENDING TITLE 6, CHAPTER 8 (FAIR HOUSING) OF THE CITY CODE OF THE CITY OF CANTON, ILLINOIS. WHEREAS, discrimination on the basis of race, color, religion, gender or national origin in the sale, rental, leasing or financing of housing or land to be used for construction of housing or in the provision of brokerage services is prohibited by Title VIII of the 1968 Civil Rights Act ("Federal Fair Housing Act"); WHEREAS, the Fair Housing Amendments Act of 1988 expanded coverage to include disabled persons and families with children; WHEREAS, the City Council of the City of Canton finds it to be in the best interests of the City of Canton to amend Title 6, Chapter 8 (Fair Housing) to recognize the legislative amendments; and WHEREAS, should any section or provision of this Ordinance be declared invalid, that decision shall not affect the validity of this Ordinance as a whole or any part thereof, other than the part so declared to be invalid; NOW, THEREFORE, be it ordained by the corporate authorities of City of Canton the following: Section 1. Section 6-8-1(A) ("Declaration of Policy") of the City Code is hereby amended to read as follows: (A) It is hereby declared to be the policy of the city, in order to promote the general welfare of the community, to assure full and equal opportunity to all residents of the city in the obtaining of fair and adequate housing for themselves and their families without discrimination against them solely because of their age, sex, race, color, religion, national origin, ancestry, disability or familial status. Section 2. Section 6-8-2 ("Definitions"), the definition of "DISCRIMINATE; DISCRIMINATION in the City Code is hereby amended to read as follows: DISCRIMINATE; DISCRIMINATION: Any difference in the terms of the sale, lease, rental or financing of any real property offered to a person applying for such sale, rental, lease or financing because of the age, sex, race, color, religion, national origin, ancestry, disability, or familial status of such person. Section 3. Section 6-8-3 ("Unfair Real Estate Practice") of the City Code is hereby amended to read as follows: (A) It shall be an unfair or discriminatory practice for any owner, lessee, sublessee, assignee, managing agent or other person, firm or corporation or any agent of these: 1 1. To withhold listings or refuse to sell, rent, lease, assign or sublease any real property or part, portion or interest therein to any person solely because of his or her age, sex, race, color, religion, national origin, ancestry, disability or familial status. 2. To discriminate against any person solely because of his or her age, sex, race, color, religion, national origin, ancestry, disability or familial status, in the terms, conditions, or privileges of sale, rental, lease, assignment or sublease of any real property or any part, portion or interest therein. 3. To discriminate or participate in discrimination in connection with borrowing or lending money, guaranteeing loans, accepting mortgages, or otherwise obtaining or making available funds for the purchase, acquisition, construction, rehabilitation, repairs or maintenance of any real property because of age, sex, race, color, religion, national origin, ancestry, disability or familial status. 4. To directly or indirectly advertise or in any other manner indicate or publicize that the purchase, rental, lease assignment or sublease of any real property or any part, portion or interest therein, by persons of any particular age, sex, race, color, religion, national origin, ancestry, disability or familial status, is unwelcome, objectionable, not acceptable or not solicited. Further, it is prohibited to make, print, or publish advertise that indicate a preference, limitation or discrimination because of age, sex, race, color, religion, national origin, ancestry, disability or familial status. 5. To solicit for sale, lease or listing for sale or lease any real property on the ground of loss of value due to the present or prospective entry into the neighborhood of any person or persons of any particular age, sex, race, color, religion, national origin, ancestry, disability or familial status. 6. To make, distribute or cause to be made or distributed any written material or statements designed to induce any owner of real estate to sell or lease his property because of any present or prospective change in the age, sex, race, color, religion, national origin, ancestry, disability or familial status of the proposed buyer or tenant. Section 4. This ordinance shall be in full force and effect immediately upon the passage of this Ordinance. PASSED THIS 16 day of April, 2020.
