HomeMy WebLinkAboutResolution #2050RESOLUTION NO. 2050 A RESOLUTION ACCEPTING AND AUTHORIZING THE EXECUTION OF A GRANT AGREEMENT BET6~lEEN THE CITY OF CAN'T'ON AND THE ENVIRONt~ITAL PROTECTION AGENCY. WHEREAS, the State of Illinois enacted an Environmental Protection Act which provides in part for the control of ~•Tater pollution in Illinois; and, WHEREAS, the Pollution Control Hoard pursuant to said Act has adopted regulations establishing water quality standards anti effluent liritations which must be attained by the City of Canton in the operation of its se~-Tage treatment plant and associated works; and, 4~"FiEREAS, grant funds havo been provicieci by the State of Illinois to assist local clovernraents in the construction of facilities ~Thich will ensure compliance PTlth th° standards and limitations established by the Lnvironr:zental Protection Act ant. regulations adopted pursuant thereto; and, WHEREAS, the City of Canton has made application for a grant from the State of Illinois for the design and construction of a sewage treatment improvement andjor modification project :~Thich will satisfy the requirements of the Environmental Protection Act and the regulations adopted pursuant thereto; and, WHEREAS, the Environmental Protection Agency of the State of Illinois has made an offer of grant for said project designated as C17 2206, a copy of which is attached as Exhibit A hereto; and, WHEREAS, the corporate authorities, after due investigation and consideration, have determined that acceptance of said grant offer and entering into a grant agreement with the State of Illinois will serve the public good and is necessary to ensure compliance with the Environmental Protection Act and regulations adopted thereunder. NOW, THII2EFORE, BE IT RESOLVED BY THE ItiiAYOR AND CITY COUNCIL OF THE CITY OF CANTOBI, Fulton County, Illinois: 1. That the I~~layor and City Council hereby finds as facts all of t;ie recitals in the Preamale of this Resolution, as ;cell as the description of t'rIe project contained in the grant offer ('exhibit A hereto). 2. `c'hat the Ila,;or and Cit__~ Council hereby accept said offer and agree to all terms anci COIlditlOllS thereof, including all special conditions, general conditions and assurances containec:Y therein and made a part hereof by reference and also agree that the grant funds awarded will be used solely for the purposes of the project as aL~proved by t'rIe Environmental Protection Agency of the State of Illinois in accordance with tl~Ie terms and conditions of said grant offer. 3. That the I+~~ayor, pursuant to prior authority, has previously executed said grant offer, Exhibit ~~ hereto. `T'hat such prior execution is hereby expressly re-authorized, confirmed and approved by the Canton City Council. -2- 4. TYiat the clerk be and is hereby directed to file a certified copy of this P,esolution t^~itiZ the said executed grant offer and transmit sufficient copies of the same to the Environmental Protection Agency of the State of Illinois at Springfield, Illinois on or before hZarch 8, 1989. 5. This resolution wall be in full force and effect from and after its passage and approval as provided by law.
