A RESOLUTION APPROVING AN AGREEMENT OF LEGAL SERVICES FOR
THE CITY OF CANTON AND DIRECTING THE MAYOR TO EXECUTE AND
DELIVER SAID AGREEMENT ON BEHALF OF THE CITY OF CANTON,ILLINOIS.
WHEREAS, the Mayor of the City of Canton (the "City") has determined that it is
necessary and in the best interests of the City of Canton to enter into an agreement for NATHAN
COLLINS of Collins&Collins,P.C.to provide certain legal services to the City as provided herein
and as set forth in Exhibit "A" attached hereto and incorporated herein, and to serve as the City's
attorney for purposes of an arbitration by and between the City and AFSCME Council 31, Local
1372 regarding Travis Pollitt(the "Grievant"); and
WHEREAS,the City Council of the City of Canton has made a similar determination and
further consents to the appointment of NATHAN COLLINS for the,purposes described above;
NOW,THEREFORE,BE IT RESOLVED BY THE MAYOR-AND CITY COUNCIL
OF THE CITY OF CANTON,ILLINOIS,AS FOLLOWS:
1. That the agreement attached hereto and incorporated herein as Exhibit "A" is hereby
approved by the Canton City Council in relation to the appointment described below.
2. That the Mayor of the City of Canton, Illinois is hereby'authorized and directed to
execute said Agreement on behalf of the City of Canton.
3. That NATHAN COLLINS is hereby appointed as the City's attorney for the limited
purpose of representing the City in a pending arbitration between the City and
AFSCME Council 31, Local 1372 regarding a Grievant,TRAVIS POLLITT.
4. That this Resolution shall be in full force and effect immediately upon its passage by the .
City Council of the City of Canton, Illinois and approval by the Mayor thereof.
PASSED by the City Council of the City of Canton, Illinois at a regular meeting this 17th
day of September, 2019 upon a roll call vote as follows:
AYES: Aldermen Ryan Mayhew, Quin Mayhew, John Lovell, Craig West, Angela Hale,
Angela Lingenfelter, Justin Nelson
NAYS: None
ABSENT: Alderman Jeff Fritz

All time spent on your case will be billed at the rate of$175,00 per hour,The hourly rats is direelly t'elaled to

You will be billed fors all time spent handling your case, including, but not limited to, the.following; court
proceedings (including travel and waiting lime appurtenant Iher'eto); negotiations; eonsultatiolhb and
trtectirtgs;.telephone,..ermail,..and.writton correspondence -legal•xcgc;u'ch;••documunt praIiarution;•discovery---- --- -- —--
and evidence depositions;and any time spent in preparation of the above,A minimum time charge of Ira hour
will be billed for reviewing all correspondence and telephone culls. In addition to the hourly lulling,you may
be assessed certain necessary costs,Those costs may include,but are not limited to,the following;filing fees,
process server fees,court reporter fees,photocopy costs, facsimile charges, subpoena costs, and witnesses'
fees.it may also be necessary to retain certain experts relative to various issues in the caro.We wIll appl'iso
you of the need for any such experts and the costs thereof.As with the above-mentioned Items,you will be
billed for any such costs,
Illinois law,as well as the Rules of Pi-ofessional Conduct,provides that an attorney's fees are not teased solely
on hours spent. In determining the reasonableness of the fees,the following are taken Into consideration; the
skill and standing of the attorneys employed,the nature of the controversy,the novelty and difficulty of the
issues involved,the amount and Importance of the subject matter,the dogree of rosponsitiility Involved in the
management of the case,the time and labor required, the usual and customary charge in the coilunualty,and
the resulting benefit to you.
