I further certify that on AUGUST 20, 2019 , the City Council of such municipality passed and approved Ordinance No 4161 entitled: AN ORDINANCE REZONING PROPERTY ON 100 WEST ELM STREET FROM A B-1 ZONING CLASSIFICATION TO A B-2 ZONING CLASSIFICATION which proved by its terms that it should be published in pamphlet form. The pamphlet for Ordinance No. 4161 including the Ordinance and a cover sheet thereof, was prepared, and a copy of such Ordinance was posted at City Hall, 2 North Main Street Canton IL, commencing on AUGUST 20, 2019 , and continuing for at least ten days thereafter. Copies of such Ordinance were also available for public inspection upon request in the Office of the City Clerk. .DATED AT CANTON, ILLINOIS, THIS A GUST 2019 Diana ley- ock, CMC, City Clerk Seal City of Canton, Illinois ORDINANCE NO. 4161 AN ORDINANCE REZONING PROPERTY ON 100 WEST ELM STREET FROM A B-1 ZONING CLASSIFICATION TO A B-2 ZONING CLASSIFICATION WHEREAS, Petitioner, MidAmerica National Bank, filed a petition with the Joint Planning & Zoning Commission for the re-zoning of the real property described below, said property being within the corporate limits of the City of Canton, Illinois; and WHEREAS, the current zoning classification of the property is B-1 and it is the petitioner's intent for the property to change to a B-2 zoning classification; and WHEREAS, after proper notice, a public hearing on said Petition was conducted by the Planning and Zoning Commission of the City of Canton on August 12, 2019; and WHEREAS, on August 12, 2019, the Planning and Zoning Commission recommended to the City Council that the real property described below be rezoned pursuant to 65 ILCS 5/11-13-1 et.seq.; and WHEREAS, it is in the best interest of the City of Canton, Illinois that said property be rezoned within the City of Canton, to meet future business growth and fit within the, City's comprehensive plan. NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Canton, Illinois as follows: 1. That the Canton City Council hereby finds as facts the assertions set forth above. 2. That the described real property be and is hereby rezoned from B-1 to B-2 as follows: Lot Number Eleven (11) in Nathan Jones' Third Addition, to the City of Canton, situated in the County of Fulton, and State of Illinois. Lot Number Twelve (12) in Nathan Jones' Third Addition, to the City of Canton, situated in the County of Fulton,in the State of Illinois. Lot Thirteen (13) in Nathan Jones' Third Addition to the Town, (now City) of Canton, Illinois, situated in the County of Fulton, in the State of Illinois. A part of Lot 22 in Jones Third Addition to the City of Canton, Fulton County, Illinois, described as follows: Commencing at a point 76 feet West of the Southeast corner of said Lot 22 in Jones Third Addition, thence North 57 feet, thence West 60 feet, more or less, to the West side of said Lot 22, thence South 57 feet, thence East 60 feet, more or less, to the place of beginning, situated in the County of Fulton, in the State of Illinois. That MidAmerica National Bank will pay to the City of Canton the fees required to file a certified copy of this Ordinance with the Fulton County Clerk and Recorder of Deeds, no later than ninety (90) days from the date of this Ordinance. 4. Upon proof of filing of a certified copy of this Ordinance, the Zoning Administrator is directed to make the appropriate map amendments to the City of Canton to reflect said re-zoning. 5. That this Ordinance shall be in full force and effect upon its passage by the City Council of the City of Canton and approval by its Mayor.
