HomeMy WebLinkAboutResolution #3073 RESOLUTION N0. 3Q73 A RESOLUTION DIRECTING DEMOLITION OIL' Il~ROYEMENTS TO REAL PROPERTY LOCATED AT 826 SOUTH SECOND AYENDE, CANTON, ILLINOIS WHEREAS, that by reason of recommendations of the Fulton County Health Department and Phillips and Associates, Inc. it has been made to appear that a house located at 826 South Second, Canton, Illinois, and more specifically described as follows: Lot 21 in E and E Johnson~s Addition to the City of Canton, situated in Fulton County, Illinois, is in dangerous and unsafe condition and that said real estate is owned by the heirs at law or devisees of Emma L. Harney, deceased. WHEREAS, Ch. 24, SS 11-31-1 et sequi, Illinois Revised Statutes empowers municipalities to demolish, repair or cause the demolition or repair of dangerous and unsafe buildings; and further empowers municipalities to apply to the Circuit Court for an Order to demolish, obtain a personal judgement for costs of demolition and the legal action, and obtain alien on said premises and to foreclose on same; and, WHEREAS, the 15 day statutory notice has previously been given by City staff pursuant to prior instructions. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Canton, Fulton County, Illinois that the building(s) located on the premises described above is hereby declared to be dangerous and unsafe within the meaning of the Statutes set forth in Ch. 24, SS 11-31-1 et sequi, Illinois Revised Statutes; and, BE IT FURTHER RESOLVED that the Canton City Attorney be and he is hereby authorized and directed to apply on behalf of the City of Canton to the Circuit Court of the Ninth Judicial Circuit of Fulton County, Illinois, for an Order authorizing the City to demolish said building, to obtain judgment for costs of every kind, and to attach a lien thereto and to foreclose the same. PASSED by the City Council of the City of Canton, Fulton County, Illinois at a regular meeting this 1st day of October, 1991, upon a roll call vote as follows: AYES: Aldermen Molleck, Coay, Sarff, Steck, Bohlen, Meade, Barnett, May.
