COUNTY OF FULTON ) CERTIFICATE I, Diana Pavley-Rock, certify that I am the duly elected City Clerk of the CITY OF CANTON, FULTON COUNTY, ILLINOIS. I further certify that on AUGUST 6. 2019 , the City Council of such municipality passed and approved Ordinance No 4154 entitled: AN ORDINANCE AMENDING PROVISIONS 5-8-2 RELATIVE TO BURNING OF YARD CLIPPINGS IN THE CITY OF CANTON ILLINOIS which proved by its terms that it should be published in pamphlet form. The pamphlet for Ordinance No. 4154 including the Ordinance and a cover sheet thereof, was prepared, and a copy of such Ordinance was posted at City Hall, 2 North Main Street Canton IL, commencing on AUGUST 6, 2019 , and continuing for at least ten days thereafter. Copies of such Ordinance were also available for public inspection upon request in the Office of the City Clerk. DATED AT CANTON, ILLINOIS, THIS th OF AUGUST 2019 Diana a ey-Rock, CMC, City Clerk Seal City of Canton, Illinois ORDINANCE NO. 4154 AN ORDINANCE AMENDING PROVISION 5-8-2 RELATIVE TO BURNING OF YARD CLIPPINGS IN THE CITY OF CANTON,ILLINOIS WHEREAS, pursuant to the Municipal Code and the City of Canton Code, the City of Canton has the authority to regulate the burning of yard clippings and year materials within its boundaries; and WHEREAS, the City Council of the City of Canton has determined that an update and amendment is required to be made pursuant to Provision 5-8-2 due to requests of the citizens of the City of Canton. NOW, THEREFORE, BE IT ORDAINED, by the City Council for the City of Canton, Fulton County, Illinois, as follows: SECTION 1: Ordinance 5-8-2 shall now provide as follows: "5-8-2: BURNING OF YARD CLIPPINGS: Open burning of leaves, grass cuttings, shrubbery cuttings, tree limbs, and other materials accumulated as the result of the care of lawns, shrubbery, vines and trees (hereinafter referred to as landscape waste). The open burning of landscape waste is prohibited within the city limits except as follows: (A) The open burning of landscape waste shall be permitted on Monday through Sunday between the hours of nine o'clock(9:00) A.M. and sunset. (B) The open burning of landscape waste shall be permitted on private property, with the consent of the owner or person in charge of the property. (C) The open burning of landscape waste is not permitted on lanes, parking areas, alleys and all paved areas. The smoke emitted from such burning shall not inhibit the flow of smooth and safe vehicular or pedestrian traffic passage. (D)No person shall burn any landscape waste unless such fire is at least twenty feet(20')from any structure. (E)Any fire resulting from the open burning of landscape waste shall be constantly attended by a competent person until such fire is extinguished. (F) The fire chief or his designee shall prohibit any open burning of landscape waste when the atmospheric conditions or other conditions at the location of the fire constitute a hazard, which include environmental, health or safety hazards." SECTION 2—That upon passage of this amendment,the City Clerk shall be instructed to submit to the Codifiers or Municipal Ordinance the said Ordinance amendment for insertion in its proper place and each copy of this Code within thirty (30) days of its final passage.
