HomeMy WebLinkAboutResolution #3053 RESOLUTION N0. 3053 A RESOLUTION ASCERTAINING THE PREVAILING RATE OF WAGES FOR LABORERS, MECHANICS AND OTHER WORKMEN EMPLOYED IN ANY PUBLIC WORKS BY THE CITY OF CANTON, ILLINOIS WHEREAS, the State of Illinois had enacted "AN ACT regulating wages of laborers, mechanics and other workmen employed in any public works by the State, county, city or any public body or any political subdivision or by anyone under contract for public works," (hereinafter referred to as the "Act") as set forth in Chapter 1~8, Section 39s-1 through 39s-12 of the Illinois Revised Statutes, 1987; and, WHEREAS, said Act requires the City of Canton, Illinois to investigate and ascertain the prevailing rate of wages as defined in said Act for laborers, mechanics and other workmen in the locality of the City of Canton, employed in the construction of public works for said City, exclusive of maintenance work. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CANTON, ILLINOIS. 1. The prevailing rate of wages in this locality for laborers, mechanics and other workmen engaged in the construction of public works coming under the jurisdiction of the City of Canton is hereby ascertained to be the same as the prevailing rate of wages for construction work in the Fulton County area as determined by the Department of Labor of the State of Illinois as of June 21, 1991, a copy of which is attached hereto and made a part by reference as Exhibit "A". 2. Nothing herein contained shall be construed to apply said prevailing rate of wages to any work or employment except public works construction of the City of Canton to the extent required by the Act. 3. The City Clerk of the City of Canton, Illinois shall publicly post and keep available for inspection by any interested party in the main office of this City of Canton this determination of the prevailing rate of wages. 4. The City Clerk of the City of Canton, Illinois shall mail a copy of this determination to any employer, and to any association of employers and to the person or association of employees who have filed, or file, their names and addresses, requesting copies of any determination stating the particular rates and the particular class of workmen whose wages will be affected by such rates. 5. The City Clerk of the City of Canton, Illinois shall promptly file a certified copy of this Resolution with both the Secretary of State of the State of Illinois and the Department of Labor of the State of Illinois. 6. The City Clerk of the City of Canton, Illinois shall cause to be published in the Daily Ledger a notice of this determination of the prevailing rate of wage is effective and that this is the determination of this public body. 7. This Resolution shall be in full force and effect upon its passage by the City Council of the City of Canton, Fulton County, Illinois and approval by the Mayor thereof. The following list is considered as those days for which holiday rates of wages for work performed apply: New Yeah Day, Memorial/Decoration Day, Fourth of July, Labor Day, Veterans Day, Thanksgiving Day, Christmas Oay. Generally, any of th holidays which fall on a Sunday is celebrated on the following Monday. This then makes work performed on Chat Monday payable at appropriate overtime rate for holiday pay. Common practice in a given local may alter certain days of celebration such as the day of Thanksgiving for Veterans Day. If in doubt, please check with IDOL. EXPLANATION OF CLASSES TRUCK DRIVER - BUILDING, HEAVY AND HIGHWAY CONSTRUCTION Class 1. Drivers on 2 axle trucks hauling lase than 9 ton. Air compressor and welding machines and broads, including those pulled separate units, truck driver helpers, warehousemen, mechanic helpers, greasers and tiremen, pickup trucks when hauling materials, tools, men to and Tram and on-the-job site, and fork lifts up to 6,000 lb. capacity. Class 2. Tw oz three axle trucks hauling more than 9 ton but hauling lase than 16 ton. A-frame winch trucks, hydrolift trucks, or aims equipment when used for transportation purposes. Fork lifts over 6,000 lb. capacity, winch trucks, four axle combination units, and tics writers. Class 3. 2w, three or four axle trucks hauling 16 tan or more. If tt is no such definition on file, the Bureau of Labor Statistics SIC list will be used. If a task to be performed Ss not subject to one the classificatians of pay set out, the Department will upon being contacted state which neighboring county has such a classification provide such rate, such rate being deemed to exist by reference Sn this document. Further, if no such neighboring county rate applies the task, the Department shall undertake a special determination, •uch special determination being than deemed to have existed under t determination.
