ORDINANCE NO. 1164
AN ORDINAP~CE AMENDING TITLE 6, CHAPTER 4 OF THE CANTON MUNICIPAL CODE RELATING
TO ANIMALS.
WHEREAS, the Legal and Ordinance Committee has determined that it is
necessary and in the best interest of the City of Canton to amend Title 6,
Chapter 4 of the Canton Municipal Code as hereinafter set forth; and,
WHEREAS, the Canton City Council has made a similar determination.
NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CANTON,
Fulton County, Illinois as follows:
1. That the Canton City Council
hereby finds the foregoing recitals to
be fact.
2. That Title 6, Chapter 4 of the Canton Municipal Code is amended by
adding thereto the following sections and provisions:
"6-4-4: LEASH FOR DANGEROUS DOG OR OTHER ANIMAL - EXEMPTIONS -
INJUNCTION - NUISANCE: It is unlawful for any person to
maintain a public nuisance by permitting any dangerous dog or other
animal to leave the premises of its owner when not under control by leash
or other recognized control methods.
Guide dogs for the blind or hearing impaired, support dogs
for the physically handicapped, and sentry, guard, or police-owned dogs
are exempt from this Section; provided, an attack or injury to a person
occurs while the dog is performing duties as expected. To quality for
exemption under this Section, each such dog shall be currently inoculated
against rabies in accordance with State Law. It shall be the duty of the
owner of such exempted dog to notify the Chief of Police of changes of
address. In the case of a sentry or guard dog, the owner shall keep the
Chief of Police advised of the location where such dog will be stationed.
The Chief of Police shall provide police and fire departments with a cata-
gorized list of such exempted dogs, and shall promptly notify such depart-
ments of any address changes reported to him.
The City, or any citizen of the City in which a dangerous dog
or other animal exists may file a complaint in the name of the City of
Canton to enjoin all persons from maintaining or permitting such, to abate
the same, and to enjoin the owner of such dog or other anumal from permitting
same to leave his premises when not under control by leash or other recognized
control methods. Upon the filing of a complaint in the circuit court, if
satisfied that this nuisance may exist, shall grant a preliminary injunction
with bond in such amount as the court may determine enjoining the defendant
from maintaining such nuisance. If .the existence of .the nuisance is establ-

fished, the owner of such dog or other animal shall be in violation of
this Section, and in addition, the court shall enter an order restraining
the owner from maintaining such nuisance and may order that such dog or
other animal be humanely dispatched.
6-4-5: EXCEPTIONS: None of the provisions of this Chapter shall be
interpreted to unreasonably be applied to the owners or users
of seeing eye dogs.
6-4-6: PENALTY: Any person who is convicted of violating any of the
provisions of this Chapter shall be subject to a fine of not
less than Twenty-five Dollars ($25.00) nor more than Two Hundred Dollars
($200.00), exclusive of court costs, for each such occurence."
3. That Sections 4 and 5 of Chapter 4, Title 6 of the Canton Municipal Code
are repealed as of the effective date of this Ordinance.
4. That this Ordinance shall be in full force and effect ten (10) days after
its passage by the City Council of the City of Canton, Fulton County, Illinois,
approval by the Mayor thereof, and publication in pamphlet form as provided by law.
PASSED by the City Council of the City of Canton, Fulton County, Illinois,
and approval by the ~~layor thereof this 15th day of September 1987 upon a
roll call vote as follows:
AYES: Aldermen Kovachevich, Steck, Sarff, Meade, Bohler, May,
Chapman
NAYS: None.
ABSENT: Alderman Zilly.
