HomeMy WebLinkAboutOrdinance #1197 ~-~; NO. 1197 AN ORDINANCE DISCONNECTING PART OF THE SOUTH HALF OF THE NORTHEAST QUARTER OF SECTION 22, TOWNSHIP 7 NORTH, RANGE FOUR EAST OF THE FOURTH PRINCIPAL MERIDIAN, FULTON COUNTY, ILLINOIS FROM THE CITY OF CANTON. WHEREAS, the real property hereinafter described was annexed into the City of Canton by Ordinance 1150 effective June 16, 1987; and, WHEREAS, the real property hereinafter described is unimproved farm ground located upon the border but within the corporate limits of the City of Canton; and, WHEREAS, said real property may be disconnected from the City of Canton pursuant to Section 7-3-4, Ch. 24, I11. Rev. Stat.; and, WHEREAS, the legal and ordinance committee has determined that it is necessary and in the best interest of the City of Canton to disconnect said real property from the City; and, WHEREAS, the Canton City Council has made a similar determination. NOW, THEREFORE, Be It Ordained By The City Council Of The City of Canton, Fulton County, Illinois, as follows: 1. That the Canton City Council hereby finds the foregoing recitals to be fact. 2. That the following described real property be, and the same hereby is, disconnected from the City of Canton pursuant to authority of Section 7-3-4, Ch. 24, I11. Rev. Stat., to-wit: Part of the South Half of the Northeast Quarter of Section 22, Township 7 North, Range 4 East of the Fourth Principal Meridian, bounded and described as follows: Beginning at the Southeast corner of Lot Number 16 of CO-DE Sub-division, First Extension, thence East 1171.3 feet, more or less, to the West right-of-way line of the Chicago, Burlington & Quincy Railroad, thence North along the West right-of-way line of the Chicago, Burlington & Quincy Railroad 368.6 feet, more or less, to a point directly East of the Northeast corner of Lot Number 13 of CO-DE Sub-division, First Extension, thence West 1171.3 feet, more or less, to the Northeast corner of Lot Number 13 of CO-DE Sub-division, First Extension, thence South 368.6 feet, more or less, along the East line of CO-DE Sub-division, First Extension, to the point of beginning, situated in the County of Fulton and State of Illinois, EXCEPTING a 60 feet strip off the East end of the above described real estate. ' 3. That the Canton City Clerk, in conformity with Section 7-3-5, Ch. 24, I11. Rev. Stat., is hereby directed, within 90 days of the passage of this Ordinance, to cause a certified copy of this Ordinance and all attachments to be filed with the Recorders Office and, also, with the Fulton County Clerk and, further, is directed to obtain receipt therefore. 4. That this Ordinance shall be in full force and effect immediately upon its passage by the City Council of the City of Canton, Fulton County, Illinois, and approval by the Mayor thereof. Pires, represent unto the Canton City Council as follows: 1. That Petitioners are 100 of the owners of record of real property described as follows, to-wit: Part of the South Half of the Northeast Quarter of Section 22, Township 7 North, Range 4 East of the Fourth Principal Meridian, bounded and described as follows: Beginning at the Southeast corner of Lot Number 16 of CO-DE Sub-division, First Extension, thence East 1171.3 feet, more or less, to the West right-of-way line of the Chicago, Burlington & Quincy Railroad, thence North along the West right-of-way line of the Chicago, Burlington & Quincy Railroad 368.6 feet, more or less, to a point directly East of the Northeast corner of Lot Number 13 of CO-DE Sub-division, First Extension, thence West 1171.3 feet, more or less, to the Northeast corner of Lot Number 13 of CO-DE Sub-division, First Extension, thence South 368.6 feet, more or less, along the East line of CO-DE Sub-division, First Extension, to the point of beginning, situated in the County of Fulton and State of Illinois, EXCEPTING a 60 feet strip off the East end of the above described real estate. 2. That there are no electors residing on said property. 3. That the subject property is unimproved farm ground located upon the border but within the corporate limits of the City of Canton. 4. That the subject real property was annexed into the City of Canton by Ordinance Number 1150 effective June 16, 1987 pursuant to §7-1-13, Chapter 24, I11. Rev. Stat. 1985. 5. That the subject real property may be disconnected from the City of Canton without harm or prejudice to any person. 6. That Petitioners desire the disconnection of said real property from the City of Canton pursuant to ~7-3-4, Chapter 24, I11. Rev. Stat. 1985. 7. That the original of the certificate of the Fulton County Clerk is attached, showing that all City taxes or assessments due up to the time of presenting of this Petition have been fully paid. WHEREFORE, Petitioners pray that the Canton City Council pass an Ordinance disconnecting the above described real property from the City of Canton. (Garland E. Pires) (Barbara J.
