HomeMy WebLinkAboutOrdinance #12281 ` r \~ ~ r ~v ORDINANCE NO. 1228 AN ORDINANCE ANNEXING CERTAIN TERRITORY TO THE CITY OF CANTON, FULTON COUNTY, ILLINOIS. (DON ROBERTSON) WHEREAS, a petition was filed with the City Clerk for the annexation of the real property described below, and said real property is not within the corporate limits of any municipality, but is contiguous to the City of Canton, Illinois, said real property being a part of the Copperas Creek Fire Protection District but not being a part of any public district, Part of the Southeast Quarter, Section 28, Township 7 North, Range 4 East of the 4th Principal Meridian, Fulton County, Illinois, being further described as follows: Beginning at an iron pin being on the West line of said Southeast Quarter and also being South 1009.83 feet from a drill hole at the Northwest corner of said Southeast Quarter; thence East 435.6 feet to an iron pin, which is the point of beginning of the tract to be described; from said point of beginning continuing thence East a distance of 78.4 feet, more or less, to the Westerly line of the land conveyed to Fulton Community Antenna Television System, Inc. by Warranty Deed dated September 23, 1965, the Grantors in said Warranty Deed being John Whetstine and Ava M. Whetstine, his wife; thence South along said Westerly line a distance of 200 feet; thence West 78.4 feet, more or less, to an iron pin; thence North 200 feet to the point of beginning; situated in the County of Fulton, in the State of Illinois, hereby releasing and waiving all rights under and by virtue of the Homestead Exemption Laws of the State of Illinois. Part of the Southeast Quarter, Section 28, Township 7 North, Range 4 East of the 4th Principal Meridian, Fulton County, Illinois, being further described as follows: Beginning at an iron pin being on the West line of said Southeast Quarter and also being South 1009.83 feet from a drill hole at the Northwest corner of said Southeast Quarter; thence East 435.6 feet to an iron pin; thence South 200.00 feet to an iron pin; thence West 435.6 feet to an iron pin being on the West line of said Southeast Quarter, thence North 200.00 feet to point of beginning, containing 2.000 acres. Part of the Southeast Quarter of Section 28, Township 7 North, Range 4 East of the Fourth Principal Meridian,. Fulton County, Illinois, being more particularly described as follows: Beginning at a point 1009.83 feet South of the Center of said Section 28, said point marked by an iron pin; thence East 514.00 feet; thence North 75.39 feet; thence West 514.00 feet; thence South 75.39 feet; to the point of beginning; subect to the rights, if any, of the public roadway purposes. WHEREAS, proper notice of the filing of the petition for annexation was given to the Trustees of Copperas Creek Fire Protection District and notice has been made and filed with the Fulton County Recorder of Deeds, WHEREAS, a public hearing on said petition was conducted by the Planning and Zoning Commission of the City of Canton on December 12, 1988 pursuant to proper notice having been published in the Canton Daily Ledger, WHEREAS, on December 12, 1988 the Planning & Zoning Commission recommeded to the City Council that the real property described in the exhibit attached hereto be annexed to the City of Canton pursuant to Chapter 24 of the Illinois Revised Statutes, -2- WHEREAS, it is in the best interests of the City of Canton, Illinois that said real property be annexed to the City of Canton. NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CANTON, ILLINOIS: 1. That the City Council finds as facts the assertions set forth above. 2. That the described real property be and is hereby annexed to the City of Canton, Illinois. 3. That the described real property be and is hereby rezoned R-2 Residential. 4. That the Zoning Administrator is directed to make the appropriate changes to the zoning maps of the City of Canton to show this annexation and zoning. 5. That the City Clerk is directed to record with the Recorder of Deeds of Fulton County and to file with the County Clerk of Fulton County a certified copy of this ordinance together with an accurate map of the annexed territory. 6. That this ordinance shall be in full force and effect upon its passage by the City Council of the City of Canton and approval by its Mayor. PASSED by the City Council of the City of Canton, Fulton County, Illinois at a regular meeting this 3rd day of January 198'9 upon a roll call vote as follows: -3- AYES: Aldermen Kovachevich, Zilly, Steck, Sarff, Meade, Bohler, May, Chapman, NAYS: None.
