HomeMy WebLinkAboutOrdinance #1262 ORDINANCE No. 1262 AIQ ORDINANCE A°iEPIDITJG O?:DINATICE NU:'3ER 1254, BEING; ~V O?tDIPIANCE E'w~1ET1DTNG TITLE 8, CTTAPTII 10 OI' TT-TE CAPITO]'t ;'~1UNICII'AL COD1: RELATING `l'O t`JA'PER ~.ATEB FIHEREAS, the Canton City Council has determined that it is necessary and in the best interest of the City of Canton to amend Ordinance No. 12511, being: An Ordinance Amending Title 8, Chapter 10 of the Canton T~Sunicipal Code Relating to ~~7ater 3'.ates, as hereinafter set forth. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF C1INTON, l ulton County, Illinois, ~:rs folloc5rs: 1. That the Canton City Council finds the foregoing recitals to be fact. ?.. That Titli 8, Chapter 10, Section 5 of the Canton P•Iunicipal Code is hereby amended by adding thereto subparagraph (J) to read as follows: "(J) In addition to the foregoing charges, the water rates shall be amended from time to time by city staff with prior Council approval, to ref lect the actual cost, including administrative expenses, of special electrical costs or expenses incurred by the City in the operation and maintenance of the City water ~~ell(s) at not to exceed 20 cents per 100 cubic feet of water per Gaell ~~hen in operation. Such actual costs shall ~.~e spread evenly and billed to city water customers in the same manner as the foregoing charges are spread and billed. Such special or extraordinary costs or expenses shall lae inu-nediately reduced or removed as the actual cost or exoense to the city is reduced or removed, except that if a pump runs for 50o or more of a billing cycle, the surcharc_;e shall be billed for the entire billing cycle." 3. That the charges contemplated in the foregoing Section 2 shall be made retroactive to and applied as of July 7, 1989. 4. 'T'hat this ordinance shall k~e in full force and effect ir~.T~.lediately upon its passage by the City Council of the City of Canton. PASSED by the City Council of the City of Canton, Fulton County, Illinois at a regular meeting this 17th day of October 1989 upon a roll call vote as follows: AYES: Aldermen Chapman, May, Bohler, Sarff, Steck, Zilly, Kovachevich.
