HomeMy WebLinkAboutOrdinance #1258ORDINANCE NO. 1258 AN ORDINANCE AMENDING TITLE 6 OF THE CANTON MUNICIPAL CODE BY ADDING THERETO CHAPTER 17 ESTABLISHING A CURFEW IN THE CITY OF CANTON, ILLINOIS WHEREAS, the Legal and Ordinance Committee has determined that it is necessary and in the best interest of the City of Canton to amend Title 6 of the Canton Municipal Code as hereinafter set forth to establish a curfew in the City of Canton; and, WHEREAS, the Canton City Council has made a similar determination. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CANTON, Fulton County, Illinois, as follows: 1. That the foregoing recitals are hereby found to be fact. 2. That Chapters 14 through 16 of Title 6 of the Canton Municipal Code are hereby reserved for future use. 3. That Title 6 of the Canton i~iunicipal Code is hereby amended by adding thereto Chapter 17 to read as follows: °' Chapter 1 7 CITY CURFEW 6-17-1: cURFEw: (a) It is unlawful in the City of Canton fora person less than 17 years of age and more than 15 years of age to be present at or upon any public assembly, building, place, street, parking lot, or highway at the following times unless accompanied and supervised by a parent, legal guardian or other responsible companion at least 18 years of age approved in writing by a parent or legal guardian or unless engaged in a business or occupation which the laws of this State authorize a person less than 17 years of age to perform: 1. Between 12:01 a.m. and 6:00 a.m. Saturday; 2. Between 12:01 a.m. and 6:00 a.m. Sunday; and, 3. Between 11:00 p.m. on Sunday to Thursday, inclusive, and 6:00 a.m. on the following day. (b) It is unlawful in the City of Canton fora person of 15 years of age or younger to be present at or upon any public assembly, building, place, street, parking lot, or highway at the following times unless accompanied and supervised by a parent, legal guardian or other responsible companion at least 18 years of age approved in writing by a parent or legal guardian or unless engaged in a business or occupation which the laws of this State authorize a person less than 17 years of age to perform: 1. Between 11:01 p.m. Friday and 6:00 a.m. Saturday; 2. Between 11:01 p.m. Saturday and 6:00 a.m. Sunday; and, 2 3. Between 10:00 p.m. on Sunday to Thursday, inclusive, and 6:00 a.m. on the following day. 6-17-2: PARENTAL RESPONSIBILITY: It is unlawful for a parent, legal guardian or other person to knowingly permit a person in his custody or control to violate Section 1 of this Chapter. 6-17-3: PENALTY: A person convicted of a violation of any provision of this Chapter shall be fined not less than $25.00 nor more than $200.00, exclusive of court costs." 3. That this Ordinance shall be in full force and effect ten (10) days after its passage by the City Council of the City of Canton, Fulton County, Illinois, approval by the ylayor thereof, and publication in the Canton Daily Ledger.
