AN ORDINANCE ANNEXING CERTAIN TERRITORY TO THE CITY OF
CANTON FULTON COUNTY, ILLINOIS OF PHIL & OPAL PHILIPPS.
WHEREAS, a petition was filed with the City Clerk
for the annexation and rezoning of the real property
described below, and said real property is not within the
corporate limits of any municipality, but is contiguous
to the City of Canton, Illinois, said real property being
a part of the Copperas Creek Fire Protection District but
not being a part of any public district,
A part of the North half of the Northeast
Quarter of Section 15, T, 7N, R. 4 E., 4 P.M.
and also being part of Tracts 3, 5 and 6 of
a platted subdivision of said Northeast
Quarter, Section 15 and recorded in volume #3
of plats on page 1, document #200738 of the
Land Records of Fulton County and being more
particularity described as follows:
From a point of the west line of Tract #5, 720
feet south of the Northwest corner of Tract #4,
running thence Southeasterly 290 feet on a line
at a variance of 1 50' with the south line of
Tract #5, to the point of beginning:
From said point of beginning run thence N. 1
50' E, 200 feet; thence S 88 10' E, 492.3 feet
to the Northwesterly right-of-way line of State
Route #78 (formerly designated as Section U-150,
S. A. Route #3), thence southwesterly along the
ROW line of said road on a curve having a radius
of 1176.3' and through an arc of 202.9' to the point
of intersection with the next described course;
thence N 88 10' W. 423.8' to the point of
beginning; containing 2.00 acres more or less
WHEREAS, proper notice of the filing of the petition
for annexation and rezoning was given to the Trustees of
the Copperas Creek Fire Protection District and an affidavit
that service of notice has been made and filed with the
Fulton County Recorder of Deeds,
WHEREAS, a public hearing on said petition was conducted
by the Planning & Zoning Commission of the City of Canton
on January 8, 1990 pursuant to proper notice having been
published in the Daily Ledger,
WHEREAS, on January 8, 1990 the Planning and Zoning
Commission recommended to the City Council that the real
property described in the exhibit attached hereto be annexed
to and rezoned in the City of Canton pursuant to Chapter
24 of the Illinois Revised Statutes,
WHEREAS, the residence situated on the described real
property has been used for many years as a one-family
residence and that the same is the highest and best use
of same,
WHEREAS, it is in the best interests of the City of
Canton, Illinois that said real property be annexed to
and rezoned in the City of Canton.
NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF CANTON, ILLINOIS:
1. That the City Council finds as facts the assertions
set forth above.
2. That the described real property be and is hereby
annexed to the City of Canton, Illinois.
3. That the described real property be and is hereby
rezoned R-1, Single-Family Residential.
4. That the Zoning Administrator is directed to make
the appropriate changes to the zoning maps of the City
of Canton to show this annexation and rezoning.
5. That the City Clerk is directed to record with
the Recorder of Deeds of Fulton County and to file with
the County Clerk of Fulton County a certified copy of this
ordinance together with an accurate map of the annexed
and rezoned territory..
6. That this ordinance shall be in full force and
effect upon its passage by the City Council of the City
of Canton and approval by its Mayor.
PASSED by the City Council of the City of Canton,
Fulton County, Illinois at a regular meeting this 16th. day
of January 1990, upon a roll call vote as follows:
AYES:. Aldermen Kovachevich, Zilly, Steck, Sarff, Meade,
Bohler, May, Chapman.
NAYS: None.
ABSENT: None.
