HomeMy WebLinkAboutOrdinance #1332.-~ . r- ORDINANCE NO. 133?_ AN ORDINANCE VACATING PART OF ANDERSON PLACE AND VACATING PART OF A NORTH- SOUTH ALLEY LYING BETWEEN SOUTH FOURTH AVENUE AND SOUTH FIFTH AVENUE, ALL LYING AND BEING WITHIN THE CORPORATE LIMITS OF THE CITY OF CANTON, FULTON COUNTY, ILLINOIS: WHEREAS, Chapter 24, Sec. 11-91-1, et sequi, Illinois Revised Statutes, provides in part that, whenever the corporate authorities of any municipality in the state of Illinois determine that the public interest will be subserved by vacating any street or alley, or part thereof, within their jurisdiction in any incorporated area, they may vacate that street or alley, or part thereof, by ordinance; and WHEREAS, the corporate authorities of the city of Canton, Fulton County, Illinois, have determined that the public interest will be subseroed by vacating a part of Anderson Place and a part of a NorthSouth alley lying between South Fourth Avenue and South Fifth Avenue, all as hereinafter more fully described and as set forth on the plat, Exhibit A, hereto; and WHEREAS, the below-described part of Anderson Place and alley and the properties thereto contiguous are wholly within the jurisdiction and corporate limits of the city of Canton, Illinois; and WHEREAS, the corporate authorities of the city of Canton, Illinois, have determined that the relief to the public from further burden and responsibility of maintaining the below-described part of Anderson Place and the North-South alley each constitute a public use or public interest authorizing the vacation. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CANTON, Fulton County, Illinois, as follows: 1. That the Canton City Council hereby finds the foregoing recitals to be fact. 2. That the following portion of Anderson Place in the city of Canton, Illinois, be and the same hereby is vacated: Commencing at the intersection of the North right-of-way line of Anderson Place with the Southeast corner of Lot 7, Block Two, ANDERSON'S FIRST ADDITION to the city of Canton, Fulton County, Illinois, running thence West 327.6 feet to the Southwest corner of Lot 6, Block Two, in said Anderson's First Addition, thence South 66 feet to the Northwest corner of Lot 1, Block Three, Anderson's First Addition, thence running East 327.6 feet to the Northeast corner of Lot 12, Block Three, Anderson's First Addition, thence North 66 feet to the place of beginning. 3. That the following portion of a NorthSouth alley lying between South Fourth Avenue and South Fifth Avenue in the city of Canton, Illinois, be and the same hereby is vacated: Commencing at the intersection of the West right-of-way line of said alley, the North right-of-way line of vacated Anderson Place, and the Southeast corner of Lot 6, Block Two, ANDERSON'S FIRST ADDITION to the city of Canton, the point of beginning; thence North along the West right-of-way line of said alley to the Northeast corner of Lot 5, Block Two of said Addition; thence East to the Northwest corner of Lot 8, Block Two of said Addition; thence South along the East right-of-way line of said alley to the intersection of said East right-of-way line, the North right-of-way line of vacated Anderson Place, and the Southwest corner of Lot 7, Block Two of said Addition; thence West along the North right-of-way line of vacated Anderson Place to the point of beginning, subject to the reservations set forth in numerical paragraph 4 of this Ordinance. 4. Each of the aforesaid vacations are specifically made subject to an easement(s) in perpetuity under, over, and across the aforesaid vacated street and alley for purposes of maintaining, placing, constructing, or reconstructing public utilities to include, but not limited to, the following: Gas and electric transmission lines; water and sewer lines; cable television lines; or any present or future utilities of whatsoever nature or description. The easement(s) hereby reserved shall be the same dimensions as those portions of the aforesaid street and alley vacated 2 t and shall run in favor of the city of Canton, all existing easement holders, and all holders of future easements and each of their respective successors and assigns. 5. The city clerk of the city of Canton, Illinois, is hereby directed to cause a cert'rfied copy of this ordinance to be filed with the office of the Fulton County Recorder of Deeds immediately upon the passage and approval of this ordinance. 6. This ordinance shall be in full force and effect immediately upon its passage by the affirmative vote of at least three-fourths of the aldermen holding office in the city of Canton, Fulton County, Illinois, and approval by the Mayor thereof.
