ORDINANCE NO. 1318
AN ORDINANCE ANNEXING AND REZONING CERTAIN TERRITORY TO THE CITY OF
CANTON, FULTON COUNTY, ILLINOIS OF LYNN SUE BISWELL OF RURAL ROUTE
THREE, EAST WALNUT LIMITS, CANTON, ILLINOIS.
WHEREAS, a petition was filed with the City Clerk for the
annexation and rezoning of the real property described below, and
said real property is not within the corporate limits of any
municipality, but is contiguous to the City of Canton, Illinois,
said real property being a part of the Copperas Creek Fire
Protection District but not being a part of any public district,
TRACT I
A part of the Southwest Quarter of Section 25 in
Township Seven North, Range 4 East of the Fourth
Principal Meridian, Fulton County, Illinois, described as
follows: Commencing at a point 786.06 feet East of the
Southwest corner of the Southwest Quarter; running thence
East 266.30 feet; thence North 225 feet to a point;
thence East 199.36 feet to a point; thence North 406.90
feet to a point; thence West 199.36 feet to a point;
thence South 374.90 feet to a point; thence West 266.30
feet to a point; thence 257.10 feet to the point of
beginning.
TRACT II
A part of the Southwest Quarter of the Southwest Quarter
of Section 25, Township Seven North, Range 4 East of the
Fourth Principal Meridian, Fulton County, Illinois,
described as follows: Commencing at a point 1052.04 feet
East of the Southwest corner of the Southwest Quarter;
thence North 225 feet thence East 199.36 feet to the
point of beginning.
WHEREAS, proper notice of the filing of the petition for
annexation and rezoning was given to the Trustees of the Copperas
Creek Fire Protection District and an affidavit that the service of
the notice has been made and filed with the Fulton County Recorder
of Deeds,
WHEREAS, a public hearing on said petition was conducted by
the Planning and Zoning Commission of the City of Canton on July 8 ,
1991 pursuant to the proper notice having been published in the
Daily Ledger,
WHEREAS, on July 8, 1991 the Planning and Zoning Commission
recommended to the City Council that the real property described in
the attached exhibit hereto be annexed to and rezoned in the City
bf Canton Pursuant to Chapter 24 of the Illinois Revised Statutes,
WHEREAS, the rezoning of the property permits the same uses to
which the property could be used prior to annexation,
WHEREAS, it is in the best interests of the City of Canton,
Illinois that said real property be annexed and rezoned into the
City of Canton.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF CANTON, ILLINOIS:
1. That the City Council finds as facts the assertions set
forth above.
2. That the described real property be and is hereby annexed
to the City of Canton, Illinois.
3. That the described real property be and is hereby rezoned
as follows: Tract I to be R-1, Single - Family Residential; Tract
II to be B-11- Business.
4. That the Zoning Administrator is directed to make the
appropriate changes to the zoning maps of the City of Canton to
show this annexation and rezoning.
5. That the City Clerk is directed to record with the
Recorder of Deeds of Fulton County and to file with the County
Clerk of Fulton County a certified copy of this ordinance together
with an accurate map of the annexed and rezoned territory.
6. That the ordinance shall be in full force and effect upon
its passage by the City Council of the City of Canton and approval
by its Mayor.
Passed by the City Council of the City of Canton, Fulton
County, Illinois at a regular meeting this ~~ day of
