HomeMy WebLinkAboutResolution #3116RESOLUTION NO. 3116 A RESOLUTION APPROVING A RELEASE OF THE CITY OF CANTON'S CLAIM AND LIEN FOR 826 S. SECOND AVE., CANTON, ILLINOIS IN EXCHANGE FOR AN AGREEMENT TO REMEDY THE PUBLIC NUISANCE AT THAT PROPERTY. WHEREAS, the CITY OF CANTON, an Illinois municipal corporation has been pursuing a condemnation matter for the improvements upon the following described property: Lot 21 in E and E Johnson's Addition to the City of Canton, ALL SITUATED IN THE CITY OF CANTON, COUNTY OF FULTON AND STATE OF ILLINOIS. (Commonly known as 826 S. Second Avenue, Canton, Illinois, ) WHEREAS, the improvements at 826 S. Second Avenue, specifically a single family residential home, were destroyed and left in ruins by a fire on June 15, 1992; WHEREAS, the ruins of that house are acknowledged to be in a dangerous condition and constitute a public nuisance; WHEREAS, the devisee of the real estate under the last Will and Testament of Emma Lou Harney, the owner of the premises at 826 S. Second Avenue, is Joel Picton of Canton, Illinois. He, together with Eleanor Vissering, the sole heir of Emma Lou Harney have Quit Claimed their interest to Mr. Dwayne Bishop of Canton, Illinois; WHEREAS, the City of Canton, through its condemnation efforts on the property at 826 S. Second Avenue, has incurred costs in the amount of $1,232.95; WHEREAS, Mr. Dwayne Bishop is willing to remove the ruins at 826 S. Second Avenue and leave the parcel in a state free of all residual from the devastation of the house; WHEREAS, the City of Canton, as lien holder on the property at 826 S. Second Avenue, recognizes the benefit of a citizen voluntarily cleaning up the property in consideration of the transfer of the property and the release of the City of Canton's lien; WHEREAS, the City of Canton recognizes that it is of an urgent nature that the clean-up efforts be made immediately and completed within a ten (10} day period because of the public nuisance involved and dangerous condition that presently exists; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CANTON, ILLINOIS AS FOLLOWS: 1. That the City of Canton hereby agrees to release its lien of $1,232.95 if the transferee, Mr. Dwayne Bishop, promises and agrees to effect the clean up and removal of all debris and residual of the improvements on 826 S. Second Avenue. It is expressly acknowledged that the transferee, Mr. Dwayne Bishop, be given ten (10) calendar days from the date of this agreement in which to fully clean up this property barring any circumstances, limited to acts of God, which would hamper these efforts. The said property should be such that it passes inspection and is approved by the Canton Police Department Code Inspection Officer. Such approval shall not be unreasonably withheld. 2. That this Resolution shall be in full force and effect immediately upon its passage by the City Council of the City of Canton, Illinois and approval by the Mayor thereof.
