RESOLIITION N0. 3193
A RESOLIITIOH APPROVING AN AGREEMENT BETWEEN THE CITY OF CANTON AND
.TEFFREY HAIIK AND CATHERINE HADS
WHEREAS, Legal and Ordinance Committee has determined that
it is necessary and in the best interest of the City of Canton
that the attached Agreement regarding regarding the extension of a
water main be entered into by the City of Canton; and,
WHEREAS, the Canton City Council has made a similar
determination.
HOW, THEREFORE, BE IT RESOLVED BY THE CITY CODNCIL OF THE
CITY OF CANTON, Fulton County, Illinois as follows:
1. That the Canton City Council hereby finds the foregoing
recitals to be fact.
2. That the Agreement, a copy of which is attached as
Exhibit A, is hereby approved by the Canton City Council and the
Mayor is hereby directed to execute and deliver the same on behalf
of the City of Canton.
3. That this Resolution shall be in full force and effect
immediately upon its passage by the City Council of the City of
Canton, Fulton County, Illinois, and approval by the Mayor
thereof .
PASSED by the City Council of the City of Canton, Fulton
County, Illinois at a regular meeting this 5th day of October,
1993, upon a roll call vote as follows:

AGRE~T FOR SPECIAL TAP FEgS
This agreement is made at Canton, Illinois on the date shown
at the end hereof and is by and between the City of Canton, an
Illinois municipal corporation ("City") and Jeffrey Hauk and
Catherine Hauk ("Hauk") and sets forth the understanding of the
parties pertaining to tap on fees for the extension of a water
line.
Whereas, Jeffrey Hauk and Catherine Hauk have privately
caused an extension to be made of a 6" water line from East
Sycamore Street to their residence and the line was financed in
whole by Hauks at a cost of $k,367.86 as shown on Exhibit A hereto
or $2,867.8b in excess of the cost of running a line for
themselves only; and,
Whereas, the City Council of the City has agreed to waive
the requirement of Section 8-21-1 of the Canton Municipal Code
that a written agreement shall be in existence and in the City's
files before any construction start;
NOW, THEREFORE it is agreed that hereafter, any person or
entity desiring to connect to the 6 inch water line herein
described before connecting shall pay to the City a tappage fee in
addition to the normal tappage fee based upon the $2,867.86 in
additional cost incurred by the Hauks to construct the larger
line.
Payments shall be made to the City Treasurer for
reimbursement as hereafter provided.
This agreement shall be fora period of ten (10) years from
the issuance of the Illinois E.P.A. permit for the line.
Reimbursement shall be calculated as follows: the first
person to tap on shall pay $2,867.86 (coat) divided by two
(properties served) or $1,433.93. The money so received shall be
divided among the earlier investor(s). When a third investor
wishes to tap on (s)he shall pay (original coat) $2,867.86 less
(amount previously paid) $1,433.93 or $1,433.93 divided by three
(properties served) or $477.98• This sum shall then be divided
among the two earlier investors et seq. so that if all properties
in the area are sold, each will share equally in the extension
coat.
Each year the principal amount shall be adjusted by the
Consumer Price Index (CPI) all CPI increases shall go to the City
for maintenanes and administration.
In witness the parties have executed this agreement on this
day of October, 1993.
