HomeMy WebLinkAboutResolution #3249 RESOLUTION NO. 3249 A RESOLUTION APPROVING AN AGREEMENT BETWEEN THE CITY OF CANTON AND CENTRAL ILLINOIS PUBLIC SERVICE COMPANY AND DIRECTING THE MAYOR TO EXECUTE AND DELIVER SAID AGREEMENT ON BEHALF OF THE CITY OF CANTON, ILLINOIS. WHEREAS, the City of Canton is installing a standby generator at the David W. O'Brien Public Safety Building; and, WHEREAS, the Canton City Council of the City of Canton has determined that it is necessary and in the best interest of the City of Canton to enter into an agreement for electric standy use relating to the use of the standby generator at the David W. O'Brien Public Safety Building, hereto attached and herein incorporated as Exhibit "A". NON, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CANTON, Fulton County, Illinois as follows: 1. That the agreement for electric standby use, hereto attached as Exhibit "A" between the City of Canton and Central Illinois Public Service Company, is hereby approved. 2. That the Mayor is hereby authorized and directed to execute and deliver said agreement on behalf of the City of Canton, Illinois. 3. That this Resolution shall be in full force and effect immediately upon its passage by the City Council of the City of Canton, Illinois. APPROVED: ~~~ ona war s, ayor ATTEST: v i arr ~ W i to City Clerk i A-2313 11/93 ELECTRIC STANDBY 115E AC~tEE)ENT (Alternate Source Art. 700, 7D7 and/or 702 by Custa~er) AfAtEEMENT, made this day of 1994, by and between CENTRAL ILLINOIS PIBLIC SERVICE COIPANY, hereinafter called "Company", and the City of Canton hereinafter called "Customer", YITMESSETH: 1. Customer desires to use a standby system in connection with the electric public utility service required by Customer in operation of Customer's Police and Fire Building and 911 System located at First & Spruce, Canton Fulton County, Illinois. 2. Customer hereby attests that the standby system will be operated as defined under Articles 700, 701 and/or 702 of the current edition of the National Electrical Code, and that said facilities will be operated as indicated below: A) Whereas alternate source is used only to provide standby service in the event of the failure of Company's service, system testing will be allowed as outlined within Section 700-4 and 701-5 of the current edition of the National Electrical Code. All testing will be for the purpose of assuring that Customer's facilities are in proper operating condition. 3. Customer shall provide and install a double-throw switch and/or Kirk Key Interlock System at Customer's expense on load side of Company's metering equipment located at Customer's said Police and Fire Building Said double-throw switch and/or Kirk Key Interlock System shall be used for transferring Customer's electric toad from Company's source of supply to Customer's alternate source of supply. 4. The double throw switch and/or Kirk Key Interlock System shall be approved by Company and shall be so designed, installed and maintained that visual inspection of actual electrical contact can be readily and conveniently made. The switch(es) shall be of suitable voltage, phase, current and interrupting rating for the type of service supplied by Company to Customer's facilities. 5. The installation shall be made in such a manner that Customer's standby system cannot under any circumstances be operated in parallel with Company's service or energize any of Company's facilities. 6. Customer shall provide to Company a single line diagram which shall be inspected and approved by Company before Customer's standby system is placed in operation. Said diagram shall, at a minimum, clearly define the location of Company's metering equipment, Customer's main switch, Customer's transfer equipment and Customer's alternate source. Said diagram shall become part of this Agreement. Any modification of Customer's electrical distribution system which would change the electrical location of the items on the approved single Line diagram would require Customer to submit to Company a revised single line diagram for Company's inspection and approval. 7. The installation of the alternate source, the double-throw switch and/or Kirk Key Interlock System, together with all auxiliary devices, shall be inspected and approved by Company before the facilities are placed in operation. The Kirk Key Interlock System shall only be approved for use by industrial and larger commercial customers. 8. Company may make periodic inspections to ensure compliance with these requirements. Modification or replacement of the double-throw switch and/or Kirk Key Interlock System of an approved installation shall be made only "after approval by Company. 9. Company shall not be liable for any loss or damage to Customer occasioned by the use of said standby system. Customer shall be liable for any loss or damage to Company resulting from the use of said standby system. Customer shall indemnify and hold Company harmless against all claims, demands, suits or judgements made, brought, or obtained by third parties against Company occasioned by the use of Customer's standby system. YRITTEN MDDIFIGTION. After its execution this Agreement shalt not be modified except in writing executed by both parties, making express reference to this Agreement and the specific provision hereof modified or amended. IN YITNESS YHEREOF, the parties hereto have caused this agreement to be executed in duplicate, in person or by its duly authorized officers or agents, day and year first above written.
