HomeMy WebLinkAboutResolution #3244 4 _ , ~, RESOLIITION N0. 3244 A RESOLIITION APPROVING AN AGREEN~TT BETWEEN THE CITY OF CANTON AND CRAWFORD, MIIRPHY & TILLY, INC. WHEREAS, Legal and Ordinance Committee has determined that it is necessary and in the best interest of the City of Canton that the attached Agreement for Engineering Services for design phase of the City of Canton solids handling improvements for the wastewater treatment plant between the City of Canton and Crawford, Murphy & Tilly, Inc. be approved; WHEREAS, the Canton City Council has made a similar determination. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COIINCIL OF THE CITY OF CANTON, Flton County, Illinois as follows: 1. That the Canton City Council hereby finds the foregoing recitals to be fact. 2. That the Agreement for Engineering Services for the design phase of City of Canton solids handling improvements for the wastewater treatment plant of the City of Canton improvements, a copy of which is attached as Exhibit A, is hereby approved by the Canton City Council and the Mayor is hereby directed to execute and deliver the same on behalf of the City of Canton. 3. That this Resolution shall be in full force and effect immediately upon its passage by the City Council of the City of Canton, Fulton County, Illinois, and approval by the Mayor thereof . PASSED by the City Council of the City9t~f Canton, Fulton County, Illinois at a regular meeting this 11 day of July, 1994, upon a roll call vote as follows: AYES; Aldermen. Chapman, May, Meade, Phillips, Molleck, Coay. NAYS: None. ABSENT: Aldermen.Bohler, Sarff. APPROVED: Donald E. Edwards, Mayor ATTEST: ~~.-~ ! , SECOND AMENDMENT TO THE AGREEMENT FOR ENGINEERING SERVICES FOR THE DESIGN PHASE OF CITY OF CANTON SOLIDS HANDLING IMPROVEMENTS WHEREAS, the CITY OF CANTON, hereinafter referred to as the "OWNER", and CRAWFORD, MURPHY & TILLY, INC., Consulting Engineers, Springfield, Illinois, hereinafter referred to as the "ENGINEER", entered into an Agreement for Engineering Services dated September 21, 1993, hereinafter referred to as the "ORIGINAL AGREEMENT," and WHEREAS the ORIGINAL AGREEMENT provides for payment as outlined in Section 1.3 of the FIRST AMENDMENT, and WHEREAS the FIRST AMENDMENT to the Agreement provides for the design and preparation of working drawings and technical specifications which will allow the OWNER to negotiate the construction contract, NOW THEREFORE, the FIRST AMENDMENT is hereby amended as follows. Revise the second paragraph of "1.3 -DESIGN PHASE" to read as follows: "It is understood the OWNER may wish to seek competitive construction bids from two parties with specific approaches that will each comply with the 40 CFR Part 503 sludge regulations. Costs for preparing bidding documents (front end contractual documents) are not included at this time." Revise Section 3 -PAYMENT, the second paragraph of Item 3.4 of the FIRST AGREEMENT to read as follows: "Payment for the services outlined in Section 1.3.1 and 1.3.3 shall be made on a lump sum basis for 75 000, unless a change or addition to the scope of work is required in which case an amendment to this agreement will be negotiated by the ENGINEER and the OWNER." Attached is Exhibit A. Revision 2 which shall be included in this amendment. The costs shown in Exhibit A. Revision 2 to be paid to the ENGINEER for the services in paragraph 1.3.2 shall not be exceeded without authorization by the OWNER. N ~~_ .~ v ~ ~ ~ y ".~ ~Q a ~ a a ~~ pa° gg 'p a ~ ~ a~ ~ ~ o • `n G W G i aC q Q-i . ~ U Q ~ , ~ U Q • •~ ^„ • i , y ~ L ~ ~ h Q~ ~ a A a U Q W U .• ~ THIRD AMENDMENT TO THE AGREEMENT FOR ENGINEERING SERVICES FOR THE CONSTRUCTION PHASE OF CITY OF CANTON SOLIDS HANDLING IMPROVEMENTS WHEREAS, the CITY OF CANTON, hereinafter referred to as the "OWNER", and CRAWFORD, MURPHY & TILLY, INC., Consulting Engineers, Springfield, Illinois, hereinafter referred to as the "ENGINEER", entered into an Agreement for Engineering Services dated September 21, 1993, hereinafter referred to as the "ORIGINAL AGREEMENT", and WHEREAS the ORIGINAL AGREEMENT provides for construction phase services as outlined in Section 1.4, and WHEREAS the ORIGINAL AGREEMENT provided for the design and preparation of working drawings and technical specifications which allowed the OWNER to accept bids for the construction contract, and WHEREAS said construction contract has been executed by the City with a Notice to Proceed date of January 2, 1995, NOW THEREFORE, the ORIGINAL AGREEMENT as amended by the FIRST AND SECOND AMENDMENTS is hereby further amended as follows. Revise paragraph 1.4.7 to read as follows: "1.4.7 -Furnish engineering, technician and survey personnel or supplement ... in accordance with the Contract Documents. It is understood this work will be performed on an as needed basis as requested by the Owner's staff. The manhour budgets for the construction services tasks are included on the attached Exhibit C." Revise Section 3 -PAYMENT, paragraph 3.4 of the AGREEMENT to read as follows: "Payment for the services outlined in Sections 1.4.1 thru 1.4.10 shall be made on a time and expense basis. The estimated manhours and costs are shown on Exhibit C attached." All other provisions of the ORIGINAL AGREEMENT as amended remain in full force and effect.
