RESOLIITION N0. 3223
A RESOLIITION APPROVING AN AGREEMErTT BETWEEN
THE CITY OF CANTON AND HARPER OIL COMPANY
WHEREAS, Legal and Ordinance Committee has determined that
it is necessary and in the beat interest of the City of Canton
that the attached Property Access Agreement - Consent Form between
the City of Canton and Harper Oil Company regarding property
located at Sycamore Terrace;
WHEREAS, the Canton City Council has made a similar
determination.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COIINCIL OF THE
CITY OF CANTON, Fulton County, Illinois as follows:
1. That the Canton City Council hereby finds the foregoing
recitals to be fact.
2. That the Property Access Agreement -Consent Form, a
copy of which is attached as Exhibit A, is hereby approved by the
Canton City Council and the Mayor is hereby directed to execute
and deliver the name on behalf of the City of Canton.
3. That this Resolution shall be in full force and effect
immediately upon its passage by the City Council of the City of
Canton, Fulton County, Illinois, and approval by the Mayor
thereof .
PASSED by the City Council of the City of Canton, Fulton
County, Illinois at a regular meeting this ~ day of April,
1994, upon a roll call vote as follows:
AYES; Aldermen Chapman, May, Meade, Sarff, Phillips, Molleck,
Cosy.
NAYS: None.
ABSENT: Alderman Bohler.

PROPERTY ACCESS AGREEMENT-CONSENT FORM
This agreement is entered into this 16th day of March, 1994 by and between Harper Oil
Company and the City of Canton ("Owner") of property located at Sycamore Terrace in Canton,
Illinois for wluch access has been requested by Harper Oil Company, and has a term of one year
from the date below, unless terminated by either party upon thirty (30) days prior written notice.
Owner hereby grants permission for property access to Harper Oil Company, its agents or
subcontractors, for the purpose of a subsurface environmental investigation.
Terms and conditions
Any damage to sod, existing grade or underground utilities caused by work
performed under this Agreement will be repaired at the sole expense of Harper Oil
Company.
2. Harper Oil Company and its subcontractors shall keep and maintain the proper
insurance, as applicable, including: Worker's Compensation, Commercial General
Liability, Comprehensive Automobile Liability and Professional Liability for
Errors and Omissions.
3. Harper Oil Company will transmit to Owner a copy of any report, analytical
results or other document it submits to IEPA, or any other federal, state or local
government agency simultaneously with its transmittal of such doi:uments to the
agency,. ' _ wn~r.
4. Harper Oil Company will mark any monitoring devices installed on Owner's
property clearly to ensure Owner's activities do not damage such devices. Owner
shall restrict its employees, tenants and agents from the work area while Harper
Oil Company's contractors are performing the work for safety reasons and to
prevent damage to contractor's equipment.
