HomeMy WebLinkAbout#4115 Amending Provision 1-18-1 and 1-18-5 Ordinance No. 4115 An Ordinance Amending Provision 1-18-1 and 1-18-5 Pertaining to Bidding Requirements for Certain City Contracts WHEREAS, pursuant to the Illinois Municipal Code the City of Canton has the ability to enter into agreements and contracts for certain work to be undertaken by third parties for the benefit of the City and its citizens; WHEREAS, the City currently has ordinances that require bidding on certain contracts that are under the required amount pursuant to the Illinois Municipal Code; WHEREAS, the City is updating Ordinance 1-18-1 and 1-18-5 to coincide with the Illinois Municipal Code. THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CANTON, FULTON COUNTY, ILLINOIS, THE FOLLOWING CITY OF CANTON CODE PROVISIONS SHALL NOW PROVIDE AS FOLLOWS: Section 1: "1-18-1: PURCHASE ORDERS AND CONTRACTS; COMPETITIVE BIDS: Except as otherwise herein provided, all purchase orders, contracts, or agreements of whatever nature, for the purchase, lease, or sale of personal property, materials, equipment, or supplies, involving any work or public improvement, to be paid in whole or in part by special assessment or special taxation, in amounts in excess of ten thousand dollars ($10,000.00), made by or on behalf of the city, shall be let by free and open competitive bidding after advertisement, to the lowest responsible bidder except those contracts that by their nature are not adapted to competitive bidding (listed below). Except as otherwise herein provided, all purchase orders, contracts, or agreements of whatever nature, for the purchase, lease, or sale of personal property, materials, equipment, or supplies, involving any work or public improvement, that are not paid in whole or in part by special assessment or special taxation, in amounts in excess of twenty-five thousand dollars ($25,000.00), made by or on behalf of the city, shall be let by free and open competitive bidding after advertisement, to the lowest responsible bidder except those contracts that by their nature are not adapted to competitive bidding(listed below): (A) Contracts for the services of individuals possessing a high degree of professional skill when the ability or fitness of the individual plays an important part; and (B) Contracts for goods and services that are economically procurable from only one source, such as for the purchase of magazines, books, periodicals, pamphlets, and reports, and of utility services such as water, light, heat, telephone, or telegraph; and 1 (C) Contracts for materials and work that have been awarded to the lowest responsible bidder after due advertisement but that due to unforeseen revisions not the fault of the contractor must be revised, causing expenditures not in excess of ten percent(10%) of the contract price; and (D) Contracts for the maintenance of, or provision of repair parts for, equipment that are made with the manufacturer or authorized service agent of that equipment when the provision of parts, maintenance, or servicing can best be performed by the manufacturer or authorized service agent; and (E) Purchases and contracts for the use, purchase, delivery, movement, or installation of data processing equipment, software, or services and telecommunications and interconnect equipment, software, and services; and (F) Contracts for duplicating machines and supplies; and (G) Purchases of equipment previously owned by some entity other than the city itself; and (H) Contracts for repair, maintenance, remodeling, renovation, or construction, or a single project involving an expenditure not to exceed twenty-five thousand dollars ($25,000.00) and not involving a change or increase in size, type, or extent of an existing facility; and (I) Contracts for goods or services procured from another governmental agency." 1-18-5: ADVERTISEMENT FOR BIDS; DEPOSITS: All proposals to award purchase orders, contracts, or agreements, to be paid in whole or part by special assessment or special taxation, in excess of ten thousand dollars ($10,000.00) and all proposals to award purchase orders, contracts, or agreements, that will not be paid in whole or part by special assessment or special taxation, in excess of twenty-five thousand dollars ($25,000.00) shall be published at least once in a secular English language newspaper (daily or weekly) of general circulation throughout the city with such publication to be not less than ten (10) consecutive calendar days in advance of the date announced for the receiving of bids. Advertisements for bids shall describe the character of the proposed purchase order, contract, or agreement in sufficient detail to enable the bidders thereon to know what their obligations will be, either in the advertisement itself, or by reference to detailed plans and specifications on file at the time of the publication of the first announcement. Such advertisement shall also state the date, time, and place assigned for the opening of bids, and no bids shall be received subsequent to a time indicated in the announcement. The Canton city council may extend the time for the opening of such bids by publication as aforesaid to a time not more than two (2) regular city council meetings subsequent to the date originally announced for the opening of bids. Bids may, as appropriate, be required to be accompanied by a cashier's check or certified check, as a deposit of good faith, in an amount not to exceed ten percent(10%) of the total bid amount." Section 2: 2 This Ordinance shall be in full force and effect upon the retirement of the upcoming retiring sergeant and shall be in full force and effect from and after its passage and adoption. Further, the City Clerk shall be instructed to provide to the codifiers of our municipal ordinance this ordinance amendment for insertion and its proper place and each copy of this code within thirty (30) days of its final passage.
