ORDINANCE NO. 1640 AN ORDINANCE AMENDING TITLE 6, CHAPTER 20, SECTION 1 OF THE CANTON MUNICIPAL CODE BY ADDING THERETO TITLE 6, CHAPTER 20, SECTION 1 RELATING TO TRUANCY AND EXCESSIVE ABSENTEEISM FROM SCHOOL IN THE CITY OF CANTON WHEREAS, the Legal and Ordinance Committee has determined that it is necessary and in the best interest of the City. of Canton to amend Title 6, Chapter 20, Section I of the Canton Municipal Code; and, WHEREAS, the Canton City Council has made a similar determination. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CANTON, Fulton County, Illinois as follows: 1. That the City Council hereby finds the foregoing recitals to be fact. 2. That Title 6, Chapter 20, Section I of the Canton municipal code shall be added to read as follows: "6-20-1: TRUANCY PROHIBITED: A. Definition: It shall be unlawful for any person under the age of sixteen (16) enrolled in a public, private or parochial school within the corporate limits of the City to absent himself or herself from attendance at said school without parental permission. Any person who shall so absent himself or herself shall be guilty of the offense of truancy and shall be subject to a fine as set forth hereafter. Emergency. or unforeseen absences due to illness or other causes beyond the control of the person so absenting himself or herself from school without parental permission shall not constitute truancy. B. False Excuse Prohibited: It shall be an offense under this Section for a parent or other individual to knowingly submit to the proper school authorities an excuse under subsection C that contains false information,, including falsification of a signature. A person convicted of an offense under this Section shall be subject to a fine set forth hereafter. C. parPntai PP*~vr+iccinn fined: Parental permission shall include permission from a person in loco arp entis and shall be given for reasons only of personal illness, serious family illness, death in the family, serious home emergencies,. necessary and lawful family support employment, valid religious justification, principal's permission or compelling family reasons. D. Notice,. Penalty, Compromise and Payment of Fines: 1. Notice: (a1 Whoever violates this section shall be notified as follows: after the fifth (5~') unexcused absence by a student a school official notifies the police departments. preferably. by fax, that a student was not in attendance and has not provided an appropriate excuse,. as defined within this section. The officer provides the copies of the school record documenting the absence. The police department shall provide the. school officials with a simple reporting form for transmission of this information which will contain the student's name, parent's name and mailing address, the days the student has unexcused absences and a place for the administration to sign. (b) The police department sends a violation notice to the student by regular mail. (c). If the violator appears in the office of the City Clerk to pay the fine within ten days, then the fine is $50.00. 2. Notice if fine is not paid within ten days. (a) If the fine is not paid within ten (IO) days, then the violation notice is forwarded to the City Attorney. (b) The City Attorney. then files the complaint and supplies the City Clerk with a copy of the complaint and summons. (c)_ The summons is sent by_ certified mail to the violator alternatively, summons is personally served on violator. (d) Persons who violate this section and who have not paid the minimum fine as set forth in paragraph 1 of this section shall be subject to penalty of no less than $75.00 and no more than $500.00. 2. That this Ordinance shall be in full force and effect immediately. upon its passage by the City Council of the City of Canton and approved by the Mayor thereof. ~ 1 PASSED by the City.
