HomeMy WebLinkAboutOrdinance #1614 c Ordinance No. 1614 AN ORDINANCE Vacating part of a East-West alley lying East of Eleventh Street and running parallel to Chestnut Street, and alley North and South lying at the East end of Peter Daily's Second Addition, within the corporate limits of the City of Canton, Fulton County, Illinois. WHEREAS, it appears to the City Counsel of the City of Canton, Illinois, that 65 II.CS 5/11-91-1 provides in pertinent part that whenever the corporate authorities of any municipality in the State of Illinois determine that the public interest will be subserved by vacating any street or alley, or part thereof, within their jurisdiction in any incorporated area, that said municipality may vacate that street or alley, or part thereof, by ordinance; and WHEREAS, the corporate authorities of the City of Canton, Fulton County, Illinois, have determined that the public interest will be subserved by vacating a part of the East-West alley lying between Eas t of Eleventh Street, and running parallel to Chestnut Street and alley North and South lying at the East end of Peter Daily's Second Addition, all as more fully hereinafter described and as designated on the attached Exhibit A, which is a plat thereof, the vacated portion of said alley being described as yellow therein; and WHEREAS, the alley described herein and the properties contiguous thereto are wholly within the jurisdiction and corporate limits of the City of Canton, Illinois; and Page 1 of 3 WHEREAS, the corporate authorities of the City of Canton, Illinois, have determined that the relief to the public from the further burden and responsibility of maintaining the alley described herein constitutes a public use or public interest authorizing the vacation; NOW THEREFORE AND BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CANTON, FULTON COUNTY, ILLINOIS. Section 1. That the City Council of the City of Canton, Fulton County, Illinois, hereby fords the foregoing recitals to be fact. Section 2. That the following portion of the North-South alley lying between F~.~t~~-of Eleventh Street and running parallel to Chestnut Street and an alley North and South lying at the East end of Peter Daily's Second Addition, in the City of Canton, Illinois, shall be and the same is hereby vacated: An alley which is Twenty (20) feet in width and is described as follows: Beginning at the Northwest Corner of Lot 17 of Peter Daily's Second Addition to the City of Canton thence East 100 feet to the Northeast Corner of Lot 18 of said Addition; thence North 20 feet; thence West 100 feet; thence South 20 feet to the point of beginning; AND An alley which is 25 feet in width and is described as follows: Beginning at the Southeast Corner of Lot 18 of Peter Daily's Second Addition; thence North 120 feet to a point directly North of the Northeast Corner of said Lot 18 thence East 25 feet; thence South 170 feet; thence West 25 feet to the point of beginning; All situated in the City of Canton and County of Fulton Section 3. That the aforesaid vacation is specifically made subject to an easement or easements, in perpetuity, under, over and across the aforesaid vacated alley for the purpose of maintaining, constructing or reconstructing public utilities Page 2 of 3 now existing therein including, but not limited to, the following: gas and electric transmission lines; water and sewer lines; and cable television lines. Section 4. The City Clerk of the City of Canton, Illinois, is hereby directed to cause a certified copy of this Ordinance to be filed with the office of the Fulton county Recorder of Deeds immediately upon the passage and approval of this ordinance. Section 5. This Ordinance shall be in full force and effect immediately upon its passage by a majority vote of the alderman holding office in the City of Canton, Fulton County, Illinois, at a regular meeting thereof on the 5th day of January , 19 99, upon a roll call vote as follows: AYES: Aldermen Shores , :Vidiffer, bade, Sarff , Phillips , 1`Iolleck, Hartford, NAYS: None, ABSENT: Alderman May, APPROVED: 'I- Donald E.
