HomeMy WebLinkAbout#4080 Position/Director Public Safety ORDINANCE NO. 4080 AN ORDINANCE AMENDING THE CITY OF CANTON MUNICIPAL CODE TO ESTABLISH THE POSITION OF DIRECTOR OF PUBLIC SAFETY WHEREAS,the City of Canton is desirous of exercising their authority to create a new position, that being the Director of Public Safety for the protection of public health, safety, morals, and welfare; and WHEREAS, in furtherance of its statutory powers to amend the Illinois Municipal Code for the City of Canton, the City Council, and the Mayor, have determined that it is in the best interest of the City to establish the position of Director of Public Safety. NOW, THEREFORE, BE IT ORDAINED, by the Mayor and the City Council for the City of Canton, Illinois, as follows: The City of Canton Municipal Code, "Title I-Administration" is amended by adding a new Chapter 24 entitled "Director of Public Safety" to provide for the creation of this position, the appointment of the position, and the duties and responsibilities of this position. 2. That the Amendment to the City of Canton Municipal Code under Title 1 Chapter 24 shall read as follows: "Chapter 24 DIRECTOR OF PUBLIC SAFETY 1-24-1: CREATED; 1-24-2: APPOINTMENT,OATH. BOND: 1-24-3: DUTIES AND RESPONSIBILITIES. 1-24-1: CREATED: There is hereby created the position of Director of Public Safety who shall manage and effectuate the duties of the Canton Fire Department and the Canton Police Department as prescribed by statute and Canton City Code (5-1-2 & 6-1-2). The Director of Public Safety shall inform the Mayor and City Council as to the business and operations of the Fire and Police Departments, and shall manage the personnel of both departments including, but not limited to, assigning duties and disciplining employees. The Director of Public Safety shall also serve as the liaison official between the City administration and the Fulton County Emergency Management and Disaster Agency. 1-24-2: APPOINTMENT,OATH,BOND: The Director of Public Safety shall be appointed by the Mayor, with the advice and consent of the City Council. S/he shall take the oath prescribed for other city officers, and enter into a bond in the penal sum of two thousand dollars ($2,000.00) with a surety company authorized to do business in the State of Illinois, as surety, conditioned for the faithful discharge of the duties of his office. 1-24-3: DUTIES AND RESPONSIBILITIES: (A) Fire. I (I) The Fire Department shall be managed and controlled by the Director of Public Safety, assisted by the Assistant Chiefs of Fire Service. The Director of Public Safety shall have all powers authorized under the statutes of the state, shall enforce all ordinances of the city, and shall have supervision over all other officers and members of the Fire Department including the right to discipline in accordance with state statutes and the Collective Bargaining Agreements entered into by the City for all bargaining units organized in each department. All duties and functions heretofore performed by the Chief of Fire under City Code or as provided by law shall be performed by the Director of Public Safety. (2) Whenever in this code reference is made to the Fire Chief or Chief of the Fire Department, such reference shall mean the Director of Public Safety and his or her designees. (B)Police. (I) The Police Department shall be managed and controlled by the Director of Public Safety, assisted by Lieutenants of the Police. The Director of Public Safety shall have all powers of the Chief of Police authorized under the statutes of the state, shall enforce all ordinances of the city, and shall have supervision over all other officers and members of the Police Department including the right to discipline in accordance with state statutes and the Collective Bargaining Agreements entered into by the City for all bargaining units organized in each department. All duties and functions heretofore performed by the Chief of Police under City Code or as provided by law shall be performed by the Director of Public Safety. (2) Whenever in this code reference is made to the Police Chief or Chief of Police, such reference shall mean the Director of Public Safety and, where applicable, his or her designees." (3) That upon passage of this amendment, the City Clerk shall be instructed to provide to the codifiers of our Municipal Ordinance this Ordinance Amendment for insertion in its proper place in each copy of this Code within thirty (30) days of its final passage.
