AN ORDINANCE GRANTING A SPECIAL USE PERMIT TO ALLOW
KENCOR ETHNIC FOODS, INC., AN ILLINOIS CORPORATION, TO
OPERATE A FOOD PROCESSING FACILITY AT 2 ENTERPRISE LANE,
CANTON, ILLINOIS, CURRENTLY ZONED 1-2.
WHEREAS, it appears to the City Council of the City of Canton, Fulton County,
Illinois, that the territory herein described is located within the corporate limits of
the City of Canton; and,
WHEREAS, a petition was filed by Kencor Ethnic Foods, Inc., an Illinois
corporation, as owner of the property to the Joint Planning and Zoning
Commission of said City requesting a Special Use and,
WHEREAS, said commission did thereupon make favorable findings of fact and
did recommend to the Canton City Council that said special use permit to allow a
food processing facility at property located at 2 Enterprise Lane, Canton, Illinois.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF CANTON, FULTON COUNTY, ILLINOIS, AS FOLLOWS:
1. That the City Council of the City of Canton, Fulton County, Illinois
hereby finds the following recitals to be fact:
2. That special use permit to allow a food processing facility at the
property currently zoned I-2 located at 2 Enterprise Lane, Canton, Illinois,
affecting real property being legally described as follows:
SEE ATTACHED EXHIBIT A
3. The proposed special use is private in character;
4. The proposed use is so designated, located, and proposed to be
operated so that the public health, safety and welfare will be protected;
5. The proposed use will not subvert or defect the primary purpose of the
Zoning Ordinance, or of the zoning district or area for which it is proposed, when
its effect is considered in conjunction with the cumulative effect of the number of
various special uses of all types already located in the adjacent area and in the City
as a whole;
6. The proposed use is of the types of uses specifically listed in Chapter
12-3 of Title 10, of the Canton Municipal code;
7. That a special use permit be granted for Kencor Ethnic Foods, Inc., at
2 Enterprise Lane, Canton, Illinois as described herein, subject to the requirements
attached hereto as Exhibit B, shall be, and the same is hereby issued to Kencor
Ethnic Foods, Inc., owner of property so long as the requirements are met;
8. That the record of the City of Canton, appropriated documents, maps
and related regulations be and the same hereby are, amended to reflect the
foregoing special use permit granted herein.
PASSED by the City Council of the City of Canton, Fulton County, Illinois, at a regular meeting
this 2I"day of February, 2017 upon a roll call vote as follows:

The Joint Planning and Zoning Commission recommends:
APPROVAL OF THIS SPECIAL USE PERMIT CONTINGENT UPON ASSURANCE FROM PETITIONERS OF THE
FOLLOWING:
•
1) Provisions will be in place to assure no odor,fumes,dirt,vibration or noise will be present
beyond the property lines.(per Petitioner's Exhibit 1)
2) All suppliers of fish must follow Hazard Analysis&Critical Control Point(HACCP)procedures,per
FDA regulation, outlined In Exhibit I.
3) There will be no open containers of fish and no outside storage of fish or waste on this property.
4) All fish will be delivered to this facility in enclosed containers. Fish will only be unloaded in a
completely enclosed area,designed by an Illinois Licensed Design Professional(Architect)
5) An additional completely enclosed area,designed by an Illinois Licensed Design Professional
(Architect),will be provided for cleanup of delivery vehicles and equipment.
