AN ORDINANCE AMENDING TITLE 8 (PUBLIC WAYS AND PROPERTY)
CHAPTER 8 (CEMETERIES, GENERAL PROVISIONS)
SECTION 4 (GRAVE MARKERS,MONUMENTS)
WHEREAS, the Lakes, Building and Grounds Committee has determined that it is in the
best interest of the citizens of Canton, Illinois, to amend Title 8 (Public Ways and Property)
Chapter 8 (Cemeteries, General Provisions) Section 4 (Grave Markers, Monuments); and
WHEREAS, the City of Canton is desirous of exercising its authority to regulate the
grave markers and monuments; and
WHEREAS, in furtherance of its statutory powers to amend the Municipal Code for the
City of Canton, the City Council and the Mayor have determined that it is the best interest of the
City to eliminate the limitation on City Council to approve the size of grave markers and
monuments.
NOW THEREFORE, BE IT ORDAINED, by the Mayor and the City Council for the city of
Canton, Illinois, as follows:
1. The City of Canton Municipal Code, Title 8 entitled "Public Ways and Property",
Chapter 8 (Cemeteries, General Provisions), Section 4 (B) (Grave Markers, Monuments)
is amended to read as follows:
8-8-4: GRAVE MARKERS, MONUMNETS:
(B) The city council may, by a majority vote of all councilmen appointed, vary any of
the foregoing size limitations to a size that they determine is in the best interests of the
cemetery. If a variance in the size of the monument or grave marker is granted, the city
shall not be liable at any time for any damage to marker or monument if it is required to
be moved or relocated. The party requesting the variance shall absolve the city, at the
time of the variance and at all times in the future, from any liability for damage to the
grave, markers or monuments.
PASSED by the City Council of the City of Canton, Illinois and approved by the Mayor
thereof this 18th day of October, 2016, upon a roll call vote as follows:

Putrich, Ryan Mayhew
NAYS: None
