HomeMy WebLinkAboutResolution #3354RESOLUTION NO. 3354 A RESOLUTION APPROVING AN AGREEMENT BETWEEN THE CITY OF CANTON AND FLOYD SPOTSER AND PATRICK FAYHEE FOR THE INSTALLATION OF A WATER LINE WHEREAS, the City Council of the City of Canton, Illinois has reviewed the terms of the Agreement, a copy of which is attached hereto and made a part hereof as Exhibit A; and, WHEREAS, the City Council of the City of Canton, Illinois has determined that it is in the best interest of the City of Canton to approve said Agreement. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCII. OF THE CITY OF CANTON, Fulton County, Illinois as follows: 1. That the Agreement For Special Tap Fees, which is attached hereto and made a part hereof as Exhibit A, is hereby approved, said agreement to be subject to and effective pursuant to the terms and conditions set forth therein. 2. That the Mayor of the City of Canton, Illinois is hereby authorized and directed to execute and deliver said Agreement For Special Tap Fees on behalf of the City of Canton. 3. That this Resolution shall be in full force and effect immediately upon its passage by the City Council of the City of Canton, Fulton County, lllinois and approval by the Mayor thereof. PASSED by the City Council of the City of Canton, Fulton County, Illinois, at a regular meeting this 3rd day of December, 1996, upon a roll call vote as follows: AYES: Alderman May, Shores, Meade, Nidiffer, Phillips, Sarff, Hartford, Molleck. Edwards, Mayor Attest: ~, Y Nancy Whites, ; ity Clerk ~R~ AGREEMENT FOR SPECIAL TAP FEES This agreement is made at Canton, Illinois on the date shown at the end hereof and is by and between the City of Canton, an Illinois municipal corporation ("City") and Floyd Spotser and Patrick Fayhee and sets forth the understanding of the parties pertaining to tap on fees for the extension of a water line. Whereas Floyd Spotser and Patrick Fayhee have privately caused an extension to be made of a 4" water line from the intersection of West Cedar Street and South Avenue B to their residences and the line was financed in whole by Floyd Spotser and Patrick Fayhee at a cost of $7283.00 as shown on Exhibit A hereto or $ 1,225.00 in excess of the cost of running a 2" line for themselves only; and, Whereas, the City Council of the City has agreed to waive the requirement of Section 8-21-1 of the Canton Municipal Code that a written agreement shall be in existence and in the City's files before any construction starts; NOW, THEREFORE it is agreed that hereafter, any person or entity desiring to connect to the 4 inch water line herein described before connecting shall pay to the City a tappage fee in addition to the normal tappage fee based upon the $6,058.00 in cost incurred by Floyd Spotser and Patrick Fayhee to construct the larger line before financial assistance from the City. Payments shall be made to the City Treasurer for reimbursement as hereafter provided. This agreement shall be for a period of ten (10) years from the issuance of the Illinois E.P.A. permit for the line. Reimbursement shall be calculated as follows: the first person to tap on in addition to Spotser and Fayhee shall pay $6,058.00 (cost) divided by three (properties served) or $2019.33. The money so received shall be divided among the earlier investor(s). When the next investor wishes to tap on (s) he shall pay (original cost) or $6,058.00 divided by four (properties served) or $1514.50. This sum shall then be divided among the three earlier investors et seq. so that if all properties in the area are sold, each will share equally in the extension cost. Each year the principal amount shall be adjusted by the Consumer Price Index (CPI) all CPI increases shall go to the City for maintenance and administration.
