RESOLUTION NO. 3 35 3
A RESOLUTION DIRECTING DEMOLITION OF IMPROVEMENTS TO REAL
PROPERTY LOCATED AT 424 SOUTH FIRST AVENUE, CANTON, II.LINOIS
WHEREAS, that by reason of recommendations of the Fulton County Health
Department and Phillips and Associates, Inc. it has been made to appear that
improvements at 424 South First Avenue, Canton, Illinois, and more specifically described
as follows:
Lots 157, 178, 191 and 201 in Wright's Addition to the City of Canton,
County of Fulton, Illinois; and,
Lot 170 in Wright's Addition to the City of Canton, Illinois, excepting
sixty-five (65) feet off the West end thereof; also excepting three (3) feet
off the North side thereof; size of said lot to be 47 feet by 114.75 feet,
situated in Fulton County, Illinois.
is in dangerous and unsafe condition and that said real estate is owned by Robert Wheeler,
III and Judith M. Wheeler.
WHEREAS, 65 II.CS 5/11-31-1 et seq., Illinois Compiled Statutes empowers
municipalities to demolish, repair and cause the demolition or repair of dangerous and
unsafe buildings; and further empowers municipalities to apply to the Circuit Court for an
Order to demolish, obtain a personal judgment for costs of demolition and the legal action,
and' obtain a lien on said premises and to foreclose on same; and,
WHEREAS, the 15 day statutory notice notice has previously been given by City
staff pursuant to prior instructions.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Canton, Fulton County, Illinois that the building(s) located on the premises described
above is hereby declared to be dangerous and unsafe within the meaning of the Statutes
set forth in 65 ILCS 5/11-31-1 et seq., Illinois Compiled Statutes; and,

BE IT FURTHER RESOLVED that the Canton City Attorney be and he is
hereby authorized and directed to apply on behalf of the City of Canton to the Circuit
Court of the Ninth Judicial Circuit of Fulton County, Illinois, for an Order authorizing the
City to demolish said building, to obtain judgment for the costs of every kind, and to
attach a lien thereto and to foreclose the same.
PASSED by the City Council of the City of Canton, Fulton County, Illinois at a
regular meeting this 5th day of November, 1996, upon a roll call vote as follows:
AYES: Aldermen May, Shores, Meade, Nidiffer, Phillips,
Sarff, Hartford.
NAYS: None .
ABSENT: Alderman Pao 11 e ck .
