Edwards Way-50 North 4th Avenue, Canton, Illinois 61520. STAFF IN ATTENDANCE Mayor Jeffrey Fritz, City Clerk Diana Pavley-Rock, Treasurer Crystal Wilkinson, Police Chief Rick Nichols, Fire Chief Tom Shubert, Public Works Director Bill Terry, WWTP Superintendent Joe Carruthers, City Engineer Keith Plavec MEDIA IN ATTENDANCE: Daily Ledger, Fulton Democrat VIDEO SERVICES BY JOE GINGER PLEDGE OF ALLEGIANCE OPENED THE MEETING -Josh Fuller from Troop 104 led the pledge of allegiance. INVOCATION- Alderman Gerald Ellis PUBLIC PARTICIPATION- TECHNICAL DIFFICULTIES Audio and Video Recording did not take place due to the technical difficulties. The City will have the audio and video system analyzed to make sure it is fixed. The City was not aware of the technical difficulties prior to the meeting. FINANCE ALDERMAN RYAN MAYHEW, CHAIRMAN-ABSENT DISCUSSION ON JOHNSON &JOHNSON LAW OFFICE TIF APPLICATION. Attorney Rabel said Attorney's-Johnson and Johnson is repairing their building (former city hall) they requested a proposal in the amount of $5,000 over the life of the TIF. The projected reimbursement rate is 50%. The TIF Administrator-Steve Klein can prepare an ordinance to be presented at the next Council meeting. LEGAL AND ORDINANCE COMMITTEE ALDERMAN WEST, CHAIRMAN DISCUSSION OF SECTION 3-2-1 OF THE CANTON MUNICIPAL CODE PERTAINING TO THE ITINERANT VENDORS AND TRANSIENT MERCHANTS-SPECIFIALLY THE REQUEST FROM JUNK IN THE TRUNK. City Clerk Diana Pavley-Rock explained that the City currently has two groups that are interested in setting up to sell items from the back of vehicles at Hardees parking lot and Label Shopper parking lot. The City has a current ordinance that requires a license as an itinerant vendor or transient merchant. The fee for the itinerant vendor and transient merchant is $80.00 plus$20.00 per day. Both of the groups feel this cost is to high and would like to see the fee eliminated or reduced. Both of the groups feel their events help promote tourism since many of the people participating come to Canton from different communities. Alderman Jim Nelson said that he does not have a problem with what the groups are wanting to do, but would like to have a smaller fee for an annual permit. Alderman Jim Nelson said the City could come up with a new classification and a new fee structure. Alderman Ellis said that he would like to see a flat fee and not a fee charged for each day. Alderman Putrich agrees that the ordinance is outdated and should be revised. In addition to creating a new classification and adjusting the fees, the City could also look to see if a bond should be required. The current ordinance states that a bond must be on file before a license could be issued. Alderman Putrich said he would like to allow these groups to setup until a decision is made regarding the changes in the current ordinance. A draft ordinance will be brought to the next council meeting. DISCUSS, CONSIDER AND VOTE ON A RESOLUTION APPROVING A FRANCHISE AGREEMENT BETWEEN THE CITY OF CANTON AND COMCAST. Discuss took place regarding a proposed contract between the City of Canton and Comcast. Concerns were raised regarding the current language in the contract regarding the underground cable. If the City wants the utilities placed underground the City would have to pay for this according to the proposed contract. This item will be tabled until the next council meeting. AN ORDINANCE AMENDING VARIOUS PENALTY SECTIONS OF THE CANTON MUNICIPAL CODE. AN ORDINANCE AMENDING TITLE 9 (TRAFFIC REGULATIONS) CHAPTER 10 (TRAFFIC SCHEDULES) SECTION 1 (STOP SIGNS) PROVIDING FOR STOP SIGNS ON ANDERSON PLACE AT SOUTH 6TH AVENUE AND SOUTH 8TH AVENUE, IN THE CITY OF CANTON, FULTON COUNTY, ILLINOIS. (1ST READING) DISCUSS, CONSIDER AND VOTE ON AN ORDINANCE AUTHORIZING THE SALE OF CERTAIN PERSONAL PROPERTY OWNED BY THE CITY OF CANTON. (1ST READING)ORDINANCE#4035 Chief Shubert said this item is for the sale of an Amkus hydraulic power unit that the fire department does not have any use for any longer. The Media-Stronghurst-Terre Haute fire protection district of Stronghurts has offered to purchase the unit for $1,500.00. The funds received would be placed into the fire department depreciation fund. MOTION and second were made by Aldermen Jim Nelson/Hale to suspend the rules for two readings. DISCUSS. CONSIDER AND VOTE ON A CLASS A TAVERN LICENSE FOR LINN LANES LLC A request for a class A liquor license was presented to the liquor commission last week for Linn Lanes LLC. The background check was completed and nothing was in the background report that would prohibit the owners from obtaining a liquor license with the City. The liquor commission made the recommendation to approve the request contingent upon receipt of the dram shop insurance and a satisfactory background check. NEGOTIATIONS, GRIEVANCE & PERSONNEL ALDERMAN TAD PUTRICH, CHAIRMAN COMMUNITY AND INDUSTRIAL DEVELOPMENT ALDERMAN JOHN LOVELL, CHAIRMAN DISCUSS, CONSIDER AND VOTE ON A SPECIAL EVENT REQUEST FROM ST. MARY'S CATHOLIC CHURCH FOR THEIR ANNUAL FUNDRAISER TO BE HELD ON AUGUST 13 2016 FROM 5.00PM- 11:00PM. The City received an application for a special event request from St. Mary's Catholic Church for their annual fundraiser to be held on August 13, 2016. Alderman Putrich explained that this event will not have any road closures and will be setup the same that it has been during previous years. PUBLIC WORKS, WATER AND SEWER ALDERMAN GERALD ELLIS, CHAIRMAN DISCUSS, CONSIDER AND VOTE ON THE REPLACEMENT OF TWO DEWATERING BELTS AT THE WWTP WWTP Superintendent Joe Carruthers explained that this item is for equipment repairs. The belts are replaced approximately every 8000 hours. The current belts in use have started to perform poorly and have 9000 hours of use on them. MOTION and second were made by Aldermen Ellis/Justin Nelson to approve the purchase of the dewatering belts at the WWTP. Attorney Rabel said the City is looking at making the ordinance consistent in the downtown area. Further discussion took place about allowing citizens adequate parking time while they shop or eat in the downtown area. Alderman Putrich suggested having two hour parking from the hours of 8:OOam-5:OOpm, but then allowing parking overnight for residents that live in the downtown area. Alderman Justin Nelson said he doesn't agree with overnight parking. He doesn't think people will be up early enough to get the cars removed by 8:OOam. Attorney Rabel said the downtown area near Jones Park is cleaned with the street sweeper. Attorney Rabel would suggest having cars removed by 7:OOam if cars are allowed to park overnight. Alderwoman Hale said she thinks there should be at least 3 hour parking on the square. Chief Nichols said he has been monitoring the traffic on the square. The square is doing a pretty good job of taking care of itself right now. The cars are moving properly. If a time limit is going to be placed, he believes a 3 hour time limit would be appropriate. Chief Nichols said that since we are not currently having problems, the City could continue to monitor the area before a final decision is made. The City will contact the Chamber of Commerce to get further input regarding the parking in the downtown area. This will be brought back to the August 16th meeting for further discussion. DISCUSS. CONSIDER AND VOTE ON THE REPLACEMENT OF THE STREET SWEEPER AND FUNDING THROUGH INCREASE IN GARBAGE RATES OR OTHER AVENUES. City Engineer Keith Plavec verified with Clifton Larson that the balance in the garbage depreciation fund is approximately$217,000. Prior discussion took place regarding garbage rate increases to help fund the purchase of a street sweeper. Alderman Nelson said he would not be in favor of using the entire amount in the depreciation fund to purchase a street sweeper, but would consider using just a portion of the depreciation fund. Alderman Justin Nelson asked about the various interest rates for the funding of a sweeper. Public Works Director Bill Terry explained that the City usually gets 5 years from a garbage truck. The approximate cost of a garage truck is$175,000.00. The City has discussed having the street sweeping performed by an outside group. Alderman Ellis explained that when you outsource you lose control over various things. Alderman Ellis said our garbage rates are very low. People would be willing to pay$1.00 more per month and citizens that he talked to would not be against it so they can continue to have the services. MOTION and second were made by Aldermen Jim Nelson/Hale to take $80,000 from the depreciation fund as a down payment for the street sweeper and finance the $150.000.00 over five budget years at approx$30.000 per year. Amended Motion and second were made by Alderman Jim Nelson/Hale to take $80,000.00 from the depreciation fund for the down payment of the street sweeper and finance the remaining balance over a 5 fiscal year period with a cap of$230.000.00. DISCUSS, CONSIDER AND VOTE ON REPAIR OR REPLACEMENT OF STREET LIGHTS ON WEST PINE STREET. The street lights on West Pine currently is not working and discussion took place regarding the repair or to have the lights removed. MOTION and second were made by Aldermen Justin Nelson/Ellis to remove the lights on West Pine Street and add a light if needed. LAKES, BUILDINGS AND GROUNDS ALDERMAN JIM NELSON, CHAIRMAN DISCUSS, CONSIDER AND VOTE ON THE CANTON LAKE ROAD IMPROVEMENTS Alderman Jim Nelson said that the approximate cost for the project would be approximately $75,000 for the needed improvements. MOTION and second were made by Aldermen Jim Nelson/Putrich to use the funds and take $50,000.00 from the lake fund and $20.000.00 from the depreciation fund going up to a max of $75,000 to finish the Canton Lake Road Improvements. The depreciation funds would be built back up as we can. COMMUNICATIONS FROM MAYOR JEFFREY A FRITZ Mayor Fritz introduced D'Aundre Evans to the Council. D'Aundre has been with the City for four weeks in the City Clerk's office. D'Aundre is taking part in the Career Link program-which receives federal grant funds for the job placement program. OLD BUSINESS NEW BUSINESS Alderman Jim Nelson announced that petitions will be available for the primary election that will be held on February 28, 2016. The only way a primary election will be held is if five or more people run for one office. August 30, 2016 is the first day petitions can be picked up.
