HomeMy WebLinkAboutResolution #3387f RESOLUTION NO. 3387 A RESOLUTION APPROVING AN AGREEMENT AGREEMENT BETWEEN THE CITY OF CANTON AND THE FULTON COUNTY EMERGENCY TELEPHONE SYSTEM BOARD RELATING TO 9-1-1 WHEREAS, the City Council of the City of Canton, Illinois has reviewed the terms of said Agreement, a copy of which is attached hereto and made a part hereof as Exhibit A; and, WHEREAS, the City Council of the City of Canton, Illinois has determined that it is in the best interest of the City of Canton to approve said Agreement. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CANTON, Fulton County, Illinois as follows: 1. That said Agreement, a copy of which is attached hereto and made a part hereof as Exhibit A, is hereby approved purusnat to the terms and conditions set forth therein. 2. That this Resolution shall be in full force and effect immediately upon its passage by the City Council of the City of Canton, Fulton County, Illinois and approval by the Mayor thereof. PASSED by the City Council of the City of Canton, Fulton County, Illinois, at a regular meeting this 15~day of July, 1997, upon a roll call vote as follows: AYES: Aldernne2z Shores, May, Nidiffer, Meade, Sarff, Phillips, Molleck, Hartford. Edwards, Mayor Attest: ancy Whites, ity Cler . r ~n~c wr~~Tm THIS AGREEMENT made this day of , 1997, by and between THE FULTON COUNTY EMERGENCY TELEPHONE SYSTEM BOARD, a local governmental body, 131 South Main Street, Lewistown, IL 61542, hereinafter called the "BOARD"; and the CITY OF CANTON, a unit of local government, 101 E. Spruce Street, Canton, IL 61520, hereinafter known as the "CITY". WITNESSETH: WHEREAS, it is the function of the BOARD to implement and establish the number "9-1-1" as the primary emergency telephone number and develop and improve emergency communi- cations procedures and facilities in such a manner as to be able to quickly respond to any person calling the telephone number "9-1-1" seeking police, fire, medical rescue and other emergency services, and WHEREAS, the BOARD has designated, established and equipped a public safety answering point at the City of Canton Police Department, 101 E. Spruce Street, Canton, IL 61520, and WHEREAS, it is anticipated by the BOARD and the CITY that the "9-1-1" emergency communication procedure would be staffed by dispatchers from the Canton Police Department and WHEREAS, it is anticipated that the "9-1-1-" system becoming effective will add an additional work load of dispatch for the Police Department, and WHEREAS, the BOARD may make payments from the surcharge 1 funds for costs of personnel attributable directly to the operation of the "9-1-1" system and WHEREAS, the Board has, by resolution, agreed to subsidize the CITY for the additional costs of personnel caused by the implementation of the "9-1-1" system. NOW, THEREFORE, in consideration of the mutual pay- ments, covenants and conditions herein contained, the BOARD and the CITY agree as follows: 1. The term of this Agreement shall be for one year commencing on the 1st day of February, 1997, up to and including the 31st day of January, 1998, and from year-to- year thereafter unless and until terminated as hereinafter provided. 2. This Agreement may be terminated at any time upon mutual agreement between the parties or by either party upon notice in writing of not less than sixty (60) days prior to the end of the agreement year or in the event the BOARD terminates the authority of the CITY to operate a public service answering point. Under no circumstances may provi- sions of essential emergency communications center services be terminated until arrangements for continued 9-1-1 ser- vices for all affected public safety agencies are made by the BOARD. 3. That the BOARD shall pay to the CITY the sum of $28,000.00 payable in monthly installments of $2,333.33 per month. Payments to commence on July 30, 1997, and on the 30th day of each and every month thereafter during the term 2 of this agreement. Payments shall be made to CITY OF CANTON, c/o City Treasurer, City Building, 210 E. Chestnut Street, Canton, IL 61520. 4. For and in consideration of the payment by the BOARD, the CITY agrees: (a) To provide certified professional competent dispatch services according to "9-1-1" nationally accepted practices and further provided that any telecommunicator absent from a scheduled shift will be replaced. (b) The CITY will be accountable for all training and for all action and activities in the discharge of duties by its dispatchers on the "9-1-1" emergency calls, including emergency medical dispatch calls and give pre-arrival instructions when appropriate; (c) CITY agrees to hold BOARD harmless from all losses, liabilities, damages, claims and expenses (including but not limited to attorneys fees) asserted against or incurred by BOARD solely attributable to dispatch errors and omissions by personnel under the control of the CITY in the ordinary course of handling emergency calls and dispatch for the "9-1-1" system. 5. BOARD agrees to hold CITY harmless from all losses, liabilities, damages, claims and expenses (including but not limited to attorneys fees) asserted against or incurred by CITY solely attributable to equipment, maintenance and/or erroneous database information arising out of or under the control of the BOARD. 3 6. Each party agrees to cooperate fully with the other and the County of Fulton to provide quality service to all persons who may have the need to use the county-wide "9-1-1" services.
