HomeMy WebLinkAboutResolution #5037 (Harvester Tax Appeal) RESOLUTION NO. 5037 RESOLUTION ALLOWING THE CITY ATTORNEY TO FILE A LETTER TO INTERVENE IN THE HARVESTER INN, LLC TAX APPEAL WHEREAS, the City of Canton Canton was notified on October 28, 2015, of an appeal taken by Canton Harvester Inn, LLC, 8670 West State Road 56, French Lick, IN, 47432, that Canton Harvester Inn, with the determination by the Fulton County Board of Review on February 13, 2015, and; WHEREAS, the appeal involves the property located at 150 North Main Street, Canton, Illinois, 61520 and is identified as PIN #09-08-27-409-001, and; WHEREAS, the City of Canton wishes to intervene in this appeal to present evidence as to the value of the property, all of which will affect the tax revenue received by the City of Canton, and; WHEREAS, by this Resolution, the City of Canton, by its in-house legal counsel, Nancy L. Rabel, wishes to intervene on its behalf with the State Property Tax Appeal Board and to submit additional evidence herewith. NOW THEREFORE,BE IT RESOLVED: 1. That Nancy L. Rabel, City Attorney, is instructed to file an intervening request on behalf of the city to the State Property Tax Appeal Board and the Fulton County Board of Review to intervene on behalf of the city for the Appeal taken by Canton Harvester Inn, LLC, for the property located at 150 North Main Street, Canton, Illinois, 61520, and identified as Fulton County PIN#09-08-27-409-001. 2. That with the request to intervene, City Attorney Nancy L. Rabel is instructed to request an extension of time to submit additional evidence in accordance with Section 1970.60 of the Illinois Administrative Code. 3. That the City Clerk is hereby instructed to certify a copy of this Resolution for submission along with the request to intervene certifying the authenticity of the Resolution and the instruction to counsel for the city to intervene on its behalf.
