HomeMy WebLinkAbout10-17-1972 Council Meeting Minutes 431 October 17, 1972 Canton City Council hold a regular meeting on October 17, 1972 in the City Council Chamber. Mayor Jennings called the meeting to order at 6:30 P.M. Present for roll call: Aldermen Rupe, Howard, Parr, Wilcoxen, Hurst, Sepich, Edwards, Berry, Peak, Cook, spencer, Yerbic, Zaborac and Kovachevich. Absent: None. Pledge of allegiance was followed by Prayer by Alderman Edwards. Alderman Yerbic moves, seconded by Alderman Spencer to accept the minutes of the previous meeting, as presented, and place on file. Voice vote. Motion carried. Mayor Jennings recommends that Alderman Cook replace Alderman Hurst on the Planning and Zoning Commission during Alderman Hurst's absence. Alderman Edwards makes a motion that Alderman Cook replace Alderman Hurst on the Planning and Zoning Commission during Alderman Burst's absence, seconded by Aldermen Rupe. Motion carried by voice vote. Petition for Variance - Eldon Bishop presented. Board of Appeals to make a report. Petition #271. Petition to annex - Carple. Alderman Hurst makes a motion to refer this Petition to the Planning and Zoning Commission, seconded by Alderman Sepich and the motion {,,,, carried by voice vote. Petition #272. 11'J Copy of Petition - David Wheeler. Motion by Alderman Hurst to refer this Petition to the Planning & Zoning Commission for study, seconded by Alderman Sepich. Motion carried by voice vote. Petition #273. �.7 Reports of Standing Committees. Alderman Sepich reports that thb Police and Legal Committee recommends that the bid of custom Signals Inc. be accepted. Alderman Sepich makes a motion that the City Clerk enter into a contract with Kustom Signals Inc. to purchase the MR Radar unit, seconded by Alderman Farr. Roll Call vote. AYE: Aldermen Kovachevich, Zaborac, Yerbic, Spencer, Cook, Peak, Berry, Edwards, Sepich, Hurst, Wilcoxen, Farr, Howard and Rupe. NAY: None. Motion carried. Alderman Parr reports on a defensive driving class to be held October 19, 26 and November 2, 1972 at Lewistown. Alderman Parr calls for a Traffic Committee meeting in the Mayor's office after the Council meeting for all the Council members, Mayor and City Attorney. Alderman Sepich calls for a Police and Legal Committee meeting Monday, October 30, 1972 at 6:30 P.M. Postal cards to be sent. Alderman Rupe reported on a meeting of the Water and Sewer Committee October 11, 1972 with residents of E. Linn St. and residents of 17th Avenue and E. Walnut Street area. !Alderman Hurst recommends that there should be some meetings with the residents of (lest Hickory concerning water and sewer. Reports of Standing Committees. Alderman Edwards reports on a meeting to be held Tuesday, October 24, 1972 at 6:30 P.M. with Mr. Rolling of the Illinois Department of Local Government Affairs. Alderman Edwards invited members of the City Council, members of the press, Chief of Police and the Sanitation Officer. Alderman Edwards recommended that there should be a pickup station for burnable objects. Mayor Jennings thanked the Fire Department and the Betterment Commission for this pickup of burnable objects. Communications to Council. Planning and Zoning Commission - Edson Van Sickle - The Meadows. Discussion Alderman Hurst makes a motion to accept t is plat , seconded by Alderman Rupe. Motion carried by voice vote. Petition 4274. Mayor Jennings reports that an advertisement for a City Engineer will be run in the Illinois Municipal Review magazine. Planning and Zoning Commission.- Replatting Darren E. Oaks property - Eastmoor. Alderman Hurst makes a motion to approve the replatting. Discussion. Alderman Hurst 434 October 17, 1972 Cont1l. (2) withdraws his motion. Alderman Sepich moves that an Ordinance be drawn vacating the cul-de-sac on Fifteenth Avenue and facing Lots 82, 83. 84 and 85, Eastmoor Addition, Section II with a proper legal description be furnished to the City Attorney, seconded by Alderman Hurst. Motion carried by voice vote. Alderman Hurst moves that the Council approve the replatting of the Darren Oaks property with the condition that the City Attorney be furnished with the proper legal description, seconded by Alderman Rupe. Roll Call vote. AYE: Aldermen Rupe, Howard, Farr, Wilcoxen, Hurst, Sepich, Edwards, Berry, Peak, Cook, Spencer, Yerbic, Zaborac and Kovachevich. NAY: None. Motion carried. Petition #275. Planning & Zoning Commission - Rezoning Johnny M. and Kathy L. Nord property. Alderman Edwards makes a motion that the Resolution be read, seconded by Alderman Peak and the motion carried by voice vote. Resolution read. Alderman Edwards makes a motion to adopt the Resolution, seconded by Alderman Hurst. Roll Call vote. AYE: Aldermen Kova,chevioh, Zaborac, Yerbic, Spencer, Cook, Peak, Berry, Edwards, Sepich, Hurst, Wilcoxen, Parr, Howard and Rupe. NAY: None. This being Resolution #601. Planning and Zoning Commission - Rezoning - Charles & Wilburta Owings property. Alderman Hurst moves that the Resolution be read, seconded by Alderman Edwards and the motion carried by voice vote. Resolution read. Motion by Alderman Hurst , seconded by Alderman Edwards to adopt this Resolution. Roll Call vote. AYES Aldermen Rape, Howard Farr, Wilcoxen, Hurst, Sepich, Edwards, Berry, Peak, Cook, Spencer, Yerbic, Zaborac and Kovachevich. NAY: None. Motion carried. This being Resolution #602. Planning and Zoning Commission - Richard Edwards property. Alderman Hurst moves that the Ordinance be moved up on the agenda, seconded by Alderman Berry and the motion carried by voice vote. Ordinance read. Alderman Hurst makes a motion to suspend the rules, seconded by Alderman Cook. Roll Call vote. AYE: Alderman Kovachevich, Zabroae, Yerbic, Spencer, Cook, Peak, Berry, Edwards , Sepich', Hurst, Wilcoxen, Farr, Howard and Rupe. NAY: None. Motion carried. Motion by Alderman Hurst, seconded by Alderman Yerbic to place the Ordinance on its passage. Roll Call vote. AYE: Aldermen Rupe, Howard, Parr, Wilcoxen, Hurst, Sepich, Edwards . Alderman Wilcoxen makes a motion, seconded by Alderman Rupe that the Mayor be authorized to enter into agreements with the T P & W Railroad and the C.I.P.S. Company under the supervision of the City Attorney. Roll Call vote AYE: Aldermen Kovachevich, Zaborac, Yerbic, Spencer, Cook, Peak, Berry, Edwards, Sepich, Hurst , Wilcoxen, Farr, Howard and Rupe. NAY: None. Motion Carried. Agreement $216.- T P & W Railroad. Agreement #217 - C.I.P.S. Co. Crawford, Murphy & Tilly - hater & Sewer Service - Spoon River College. Approval of Zoning variance by Board of Appeals - Clifford Crandall. Association of Commerce & Industry - Rot Spoon River Scenic Drive. Request - Tag Day and Candy sale - Knights of Columbus - Nov. 24, 25, 1972. Alderman Spencer moves that the request be allowed if there are no conflicting dates, seconded by Alderman Kovachevich. Motion carried by voice vote. Request - Temple Baptist Church to use bandstand for a Youth Singing Group (October 28, 1972). Alderman Yerbic makes a motion that the request be allowed, seconded by Alderman Peak. Motion carried by voice vote. Old Business. Report on Estel Kern property by City Attorney Malmgren. Ordinance - 2nd reading - Annexation - Orwig, Estes, Mid Century and Sherwood Forest. Discussion. Motion by Alderman Edwards, seconded by Alderman Cook that this Ordinance be placed on its passage. Roll Call vote . AYE: Aldermen Rupe, Howard, Farr, Wilcoxen, Edwards, Berry, Peak, Cook and Yerbic. NAY: Aldermen Hurst, Sepich, Spencer, Zaborac and Kovachevich. 9 AYES and 5 NAYS. Motion carried. This being Ordinance #390. Ordinance - 2nd reading - Annexation - Gene Wrestler property. Discussion. Motion by Alderman Spencer, seconded by Alderman Yerbic to place the Ordinance on its passage. Roll Call vote. Alderman Kovachevich, Zaborac, Yerbic, Spencer, Cook, Peak, Berry, Edwards, Sepich, Hurst, Wilcoxen, Farr, Howard and Rupe. NAY: None. Motion carried. This being Ordinance #391. October 17, 1972 Contf .d (3) Mayor Jennings requested that Alderman Hurst check on a ruling on plats being presented to Planning and Zoning Commission. Discussion on Mobile Home Courts. Alderman Howard left Council Chambers at 7:55 P.M. Alderman Hurst moves that if the water line is in to the Wrestler property, that the water be shut off by the Plumbing Inspector until the sewer line is paid for, seconded by Alderman Rupe. Motion carried by voice vote. Mayor Jennings introduced Marcella Mosher, Michele Conrad and Timothy Lowe who are enrolled in a Citizenship course at the Free Methodist Church. Alderman Howard returned to Council Chambers at 8:00 P.M. Mr. Edson Van Sickle thanked the City Council for their cooperation. New Business. Highway permit - Sewer and water line along highway. Motion by Alderman Yerbic to U_ authorize Mayor Jennings to sign this Highway Pemit under legal advisement, seconded ifJ by Alderman Sepich. Roll Call vote. AYE: Aldermen Rupe, Howard, Farr, Wilcoxen, Hurst, Sepich, Edwards, Berry, Peak, Cook, Spencer, Yerbic, Zaborac and Kovachevich. LLB NAY: None. Motion carried. Agreement #218. U Mayor Jennings asks for authorization to impose a curfew for Halloween if necessary. Motion by Alderman Farr to authorize Mayor Jennings to impose a curfew, if he sees fit, up to 18 years of age, seconded by Alderman Berry. Roll Call vote. AYES Aldermen Kovachevich, Zaborac, Yerbic, Spencer, Cook, Peak, Berry, Edwards, Sepich, Hurst, Wilcoxen, Farr, Howard and Rupe. NAY: None. Motion carried. Ordinance - amending Liquor Ordinance - regulating sale of liquor. Alderman Sepich makes a motion to suspend the males, seasaded by Alderman Yerbic. Roll Call vote. AYE: Aldermen Rupe, Howard, Farr, Wilcoxen, Hurst, Sepich, Edwards, Berry, Peak, Cook, Spencer, Yerbic, Zaborac and Kovachevich. NAY: None. Motion carried. Motion by Alderman Sepich to place the Ordinance on its passage, seconded by Alderman Yerbic. Roll Call vote. AYE: Albrmen Kovachevich, Zaborac, Yerbic, Spencer, Cook, Peak, Berry, Edwards, Sepich, Hurst , Wilcoxen, Farr, Howard and Rupe. NAY: None. Motion carried. Ordinance #392. Canton share of expense - West Central I]_linois Council of Public Officials - $450.00. Motion by Alderman Howard that Canton pay their designated share of expenses, seconded by Alderman Yerbic. Roll Call vote. AYE: Aldermen 8ape,` H0*ar4, Farr, Wilcoxen, Hurst, Sepich, Edwards, Berry, Peak, Cook, Spencer, Yerbic, Zaborac and Kaftchevich. NAYS None. Motion carried. Auxiliary Police appointment - Ronald Haynes. Motion by Alderman Howard, seconded by Alderman Spencer that this appointment be confirmed. Motion carried by voice vote. Alderman Rupe reports on condition of Addressograph Machine in the Water Department. Alderman Rupe appoints a committee consisting of Alderman Everett Howard, Chairman; Don Edwards, Louis Sepich, Paul Spencer and John Yerbic to recommend what should be done about the addressograph. Bids - Cable Control. Alderman Sepich moves that the Deruty City Clerk be authorized to open the bids, seconded by Alderman Hurst and the motion carried by voice vote. Bids opened: Peoria Tractor & Eouipment Co. - one(l) new Caterpillar #127 Cable Control Unit - $6,600.00. One (1) reconditioned Caterpillar #29 Cable Control Unit - $5,600.00. Alderman Sepich makes a motion to refer the Bids to the Street and Alley Committee, Water & Sewer Committee and the Finance Committee, seconded by Alderman Rupe. Motion carried by voice vote. Alderman Kovacrevich announced that the Fulton County Landfill will be closed Mondev, October 23, 1972 (Veteran's Day). He further announced that the pick up woul"d be Saturday, October 21, 1972 and he would put the proper notice in the newspapers. 436 October 17, 1972 Contid. (4) Alderman Parr called for the meeting of the Traffic Committee, Council members, Mayor and City Attorney to be held in the Council Chambers instead of the Mayor's office.
