HomeMy WebLinkAbout09-05-1972 Council Meeting Minutes 4 2 1. Sept. 5, 1972 Canton City Council held a regular meeting on Sept. 5, 1972 in the City Council Chamber. Mayor Jennings called the meeting to order at 6:30 P. M. Present for roll call: Aldermen Rupe, Howard, Wilcoxen, Hurst, Sepich, Edwards, Berry, Peak, Cook, Spencer, and Kovachevich. Absent: Aldermen Farr and Yerbic. Pledge of Allegiance was followed by invocation by Alderman Edwards. Minutes of previous meeting. Motion by Alderman Spencer that the min- utes of the previous meeting be accepted, as amended, and placed on file. Alderman Peak seconds the motion and voice vote carried. Bills for August. Motion by Alderman Howard, seconded by Alderman Ed- wards that all bills properly approved be allowed for payment. Roll call vote. AYE: Aldermen Kovachevich, Spencer, Cook, Peak, Berry, !dwards, Sepich, Hurst, Wilcoxen, Howard, and Rune. NAY: None. Petition - Request for variance, premises of Ralph and Jean Froehling, �4 N. 7th Ave. - Same to be discussed at a public hearing of the Zoning Board of Appeals on Sept. 6, 1972, 6:45 P. M. Petition No. 262. Petition - Request for variance, premises of Jerry and Lillian Jarnagin, �j Northwest corner Cass Place and North Avenue C., public hearing set for V Sept. 6, 1972, 6:30 P. M. Petition No. 263. Petition - Request for rezoning or Special Use Permit - Charles W. and Wilburta Owings - 27 North Ninth Ave. Motion by Alderman Edwards, sec- onded by Alderman Hurst to refer same to the Planning and Zoning Commission and the motion carried, voice vote. Petition No. 264. Petition - Request for Rezoning from an R-2 to an R3 classification, Richard L. and Billie J. Edwards, on the South side of Myrtle Street be- tween Ninth. and Eleventh Avenues. Motion by Alderman Edwards seconded by Alderman Berry to refer this Petition to the Planning and fining Com- mission and the motion carried, voice vote. Petition No. 265. Standing Committee reports. Traffic. Alderman Kovachevich, regarding noise pollution, was very pleased with the number of arrests of violators. Many citizens have complimented the Police Department and some "bike" riders have asked for a check-up on their "bikes". Police and Legal. Alderman Sepich announced a meeting of the Police and Legal Committee, Sept. 16, 1972, 9:30 A. M. at the Police Station. Special Committee reports. Alderman Edwards reminded the Officials of the retirement party to be held for City Engineer Howard Gibbons. Lake Development Committee. Alderman Hurst reported that the Department of Conservation had approved the building of rest rooms at the boat dock - providing their demands were met (water flow and fill in washes and seeded before Sent. 16 for inspection on Sept. 17 and bids to be let on Sept. 20. Maintenance Supervisor and Street Superintendent to do this work. Communications to Council. Thank you note for flowers sent to Mrs. Vada Kovachevich. Crawford, Murnhy & `filly letter regarding water and sewer services to Spoon River Junior College -- stating the necessary steps to be taken by the City with reference to the HUD grant, easements with the TP&NIRR and C.I.P.S.Co. Mayor Jennings reported that Congressman Tom Railsback had notified him of the Federal Grant. Betterment Commission -- Suggestions made for the betterment of the City . 422 Sent. 53 1972, Cont. (2) Street and Alley. Alderman Howard reported that citizens are placing brush on their terraces for removal by the Street Department at any time they, the citizens, wish and that something must be done to get rid of this nuisance -- some definite date should be designated. Street and Alley - and Garbage Disposal Committee -- meeting to be held Sept. 12, 1972, 6:30 P. M. Environmental Protection Agency -- approval of proposed water line - N.Main. Department of Transportation approval of contract with the Geo. E. Hoffman & Sons for East Chestnut Street improvements - $5,287.25 - White Court to Second Avenue. Letter addressed to City Attorney, William Malmgren, regarding the Clarence Short property, 420 S. Th-_rd Ave., stating the premises would soon be cleared. Alderman Hurst also requested that Mr. Short mow weeds on his Mulberry Place property. Request for Tag 'Day for FISH on Sept. 30. Motion by Alderman Hurst, sec- onded by Alderman Rupe to grant this permission and the motion carried by voice vote. Municipal Association of the Central Region -- invitation to a free dinner in Bushnell, Sept. 13, 6:30-7:00 P.M. with request for reservations to be made with Canton City Clerk before Sept. 11. Illinois Commerce Commission, continuance of hearing to Sept. 6, 1972, Cable TV. Zoning Board of Anneals report on the public hearing for the American Oil Co. for variance on property on Fifth Avenue and Chestnut St., car wash to be placed on the existing shed -property -- no closer than twelve feet from the West property line. Zoning Board of Appeals -- application for hearing -- same to be held Sent. 6, 1972, 6:30 P. 14. -- Jerry and Lillian Jarnigan. Wa"Germain under Route 78, Canton Township Highway Commissioner, gave approval for same. Alderman Hurst inquired about the County Board of Appeals public hearings and that the City of Canton should be represented on the Board of Zoning Appeals. Mayor Jennings appointed Alderman Hurst to attend the next meet- ing of the County Board of Appeals and City Attorney to accompany him. Al- derman Howard opposed to granting variations of Zoning and the City should voice opinion on the one and one-half mile area. Motion by Alderman Howard, seconded by Alderman Spencer to instruct those representing the Council to make the Council's desires known and that we should have some authority. Voice vote carried. Old business. Tax Levy Ordinance up for second reading. Motion by Alderman Fdwards, seconded by Alderman Peak to read same by Title only and the motion carried by voice vote. Title read. Motion by Alderman Hurst, seconded by Alder- man Peak to place the Ordinance on its passage. Roll call vote. AYE: Al- dermen Rune, Howard, TTilcoxen, Durst, Sepich, Edwards, Berry, Peak, Cook, Apencer, and Kovachevich. NAY: None. This being Ordinance No. 387. Street openings. Alderman Hurst stated that street openings have been made by Utility companies that have not had the prover closing and holes are appearing in streets. Discussion as to what department should have charge of street openings until an engineer has been employed. Alderman Hurst moves that the Ordinance Committee draft an Ordinance giving the Zoning Officer power to issue street openings. Discussion. Motion with- drawn and Alderman Hurst moves that a terporary permit be given to Mr. Ray Hartle to issue street openings. Motion seconded by Alderman Cook. Roll call vote. AYE: Aldermen Kovachevich, Spencer, Cook, Peak, Berry, Edward s, Sepich, Hurst, Wilcoxen, Howard, and Rune. NAY: None. Motion by Alderman Edwards, seconded by Alderman Rupe that an ad be placed in the newspapers to get in touch with the Zoning Officer regarding street openings. 4 Sent. 5, 1972, Cont. (3) Sewer Installations. It was stated that the City Engineer and the Plumbing Inspector did work together on these projects and that T,Ir. White, Plumbing Inspector, should continue to do this work. New business. Bonds, approved by the Finance Committee for: Elaine Scott, Water Dept. in the amount of .;,2,000.00 (Travelers Tnc.), Wendy Hurst, Cashier at Canton Lake Beach x1,000.00 (Transamerica Tns. Co.), and Ruby Pollitt, Supervisor of Camping Area ''1,000.00 (Transamerica Ins. Co.), presented. Motion by Alderman Edwards, seconded by Alderman Hurst that same be accept- ed. Voice vote carried. Resolution, Motor Fuel Tax Funds for resurfacing Seco _d Avenue from Lo- cust Street to Spruce Street, A)5,000.00 presented. Motion by Alderman Sepich, seconded by Alderman Sovachevich to adopt Vi.is Resolution. Roll call vote. AYE: Aldermen Rupe, Howard, Wilcoxen, Hurst, Sepich, "I-dwards, Berry, Peak, gook, Spencer, and Tovachevich. NAY: None. Resolution 596. Resolution - Street lights - Market Court at rear of Comfort Station and three lamps south of Bradley Corners. AYE: Aldermen Kovachevich, Spencer, Cook, Peak, Berry, Edwards, Sepich, Hurst, and Wilcoxen. NAY: Aldermen Howard and Rupe. (9 AYES and 2 NAYS) . Resolution No. 597. Chief of Police James Elam stated there was need for a street light on Liberty Place, between Fifth and Sixth Avenue. Department of Transportation, Resolution, highway Permit for watermain along Route 78 (N. Main St.) . Motion by Alderman Hurst, seconded by Alderman Peak to adopt this Resolution. Roll call vote. AYE: Aldermen Rupe, Howard, Wilooxen, Hurst, Sepich, Edwards, Berry, Peak, Cook, Spen- cer, and Kovachevich. NAY: None. Resolution No. 598. Resolution - Larry A. Cook for Special Use Permit, 576 Baxter Court, for use as a real estate brokerage. Motion by Alderman Hurst, seconded by Alderman 'Hilcoxen to adopt this Resolution. Roll call vote. AYE: Aldermen Rupe, Howard, Wilcoxen, Hurst, Sepich, Edwards, Berry, Peak, Cook, Spencer, and Kovachevich. NAY: None. Resolution 600. Appointment of Floyd Spotser, Jr. as Auxiliary Police. Motion by Alderman Howard, seconded by Alderman Sepich to accept this appointment. Roll call vote. AYE: Aldermen Kovachevich, Spencer, Cook, Peal;, Berry, Edwards, Sepich, Hurst, Wilcoxen, Howard, and Rupe. NAY: None. J)nior Knowles property on Fulton Place. James -lam, Chief of Police, delivered this complaint to Lewistown on Au Just 25, but as far as he knew, the papers had not been served. h?uscular Dystrophy -- T-layor Jennin gs explained the mix-up on the volunteers working for Muscular "Dystrophy on Labor Day -- so many volunteers had appeared to work the e r on . , , proper identification tags had not been given to everyone. The Jay Cees apologized and stated next time the work would be carried out in a different manner. Street lights. Alderman Howard stated some tyre of policy should be set regarding the placing of street lights -- because of our newly annexed areas. Alderman Berry to meet with his Covuhittee. 424. Sept. 5, 1972, Cont. (4) Building 'Permits. IIZr. Ray Hartle, Zoning Enforcing Officer, stated he had a little difficulty with Mr. Edgar Thomas, 314 W. Spruce St., who questioned the legality of paying for a building permit. The City Attorney quoted the Ordinance regarding payment of building permits and that the integrity of the Ordinance should be enforced. AYE: Aldermen Rupe, Howard, Wilcoxen, Hurst, Sepich, Edwards, Berry, Peak, Cook, Spencer, and Kovachevich. NAY: None. Alderman Spencer reported an incidence -- 9th Ave. and Elm St. (Weaver) , City not to get involved in lot line measurements. Block party -- request to use East Spruce Street from 6th to 7th Avenue, Sent. 16 (raindate Sept 23) 6:00 P. M. Motion by Alderman Hoard seconded by Alderman Cook to recommend that same be granted since it was good for the residents of any area to become better acquainted. Voice vote carried. Clarence "Poke" Kinsel had requested permission to speak to the Council regarding hauling lime. Motion by Alderman Edwards, seconded by Alderman Rune to grant permission to Mr. Kinsel to sneak to the Council about lime hauling. Alderman Hurst moves to amend the motion that Mr. Kinsel not be permitted a,o discuss past awarding of contract, motion seconded by Alder- man Kovachevich. Roll call vote on the amendment: AYE: Aldermen Kovache- vich, Cook, Peak, Berry, and Hir-st. NAY: Aldermen Spencer, Edwards, Sepich, Wilcoxen, Howard, and Rupe. (5 AY71S and 6 NAYS) . Motion lost. Roll call vote on the motion. AYE: Aldermen Rupe, Howard, Wilcoxen, Hurst, Sepich, Edwards, Berry, Peak, Cook, Spencer, and Kovachevich. NAY: None. Mr. Kinsel said he did not understand why the statements that he had done un- satisfactory work when he had removed the gas station on Main and Locust Street and torn down the old comfort station to the sati.9faction of the Council. He stated he thought the letting of bids was unfair since he was the low bidder. Discussion. The work that had been unsatisfactory was some hauling that had been done for the water department. Mayor Jennings wanted to go on record, regarding the newspa--)er article, that the City was satisfied with his demolition work. T,Totion by Alderman Howard, seconded by Alderman Rupe to adjourn.
