HomeMy WebLinkAboutOrdinance # 1951ORDINANCE NO. 19 51 AN ORDINANCE RE-ZONING CERTAIN PROPERTY IN THE CITY OF CANTON, FULTON COUNTY, ILLINOIS. WHEREAS, a Petition for Re-Zoning, signed by the owner of record of the real estate hereinafter described, was filed before the Planning and Zoning Commission of the City of Canton, Illinois, requesting that said real estate be re-zoned from I-1 (Light Industrial District) to an R-3 (Two Family Residential District) zoning classification; and WHEREAS, the real estate which is the subject of this Petition is located at 825 Grant Place, in the City of Canton, Fulton County, Illinois and is legally described as follows: Lot One (1) in G & M Subdivision, a subdivision of Lot Five (5) of Carl Subdivision, a subdivision of a part of Lot One (1) in Barlow & Webster Addition and a part of the Old Toledo, Peoria and Western Stock Yards, all in the Northwest Quarter of Section Thirty-five (35), Township Seven (7) North, Range Four (4) East of the Fourth Principal Meridian, in the City of Canton, Fulton County, Illinois; and WHEREAS, E & M Real Estate Holdings, LLC is the owner of record of the real estate to be re-zoned and there are no other owners of record; and WHEREAS, the real estate to be re-zoned is within the corporate limits of the City of Canton, Illinois; and WHEREAS, all petitions, documents and other necessary legal requirements are in full compliance with the statutes of the State of Illinois and the ordinances of the City of Canton, Illinois and proper notice of the filing of the Petition for Re-Zoning was given as provided by law; and WHEREAS, a public hearing was held before the Planning and Zoning Commission of the City of Canton, Illinois on October 13, 2008, pursuant to proper notice published in The 1 Daily Ledger, a secular newspaper having a general circulation in the City of Canton, County of Fulton and State of Illinois; and WHEREAS, on October 13, 2008, the Planning and Zoning Commission of the City of Canton, Illinois recommended to the City Council of the City of Canton, Illinois that the real estate described above be re-zoned from I-1 (Light Industrial District) to an R-3 (Two Family Residential District) zoning classification; and WHEREAS, the highest and best use of the real estate described above is for two family residential purposes; and WHEREAS, it is in the best interest of the City of Canton, Illinois that said real estate be re-zoned from I-1 (Light Industrial District) to an R-3 (Two Family Residential District) zoning classification. NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Canton, Fulton County, Illinois, as follows: 1. That the City Council finds as facts the recitals hereinabove set forth. 2. That the real estate described above be re-zoned from I-1 (Light Industrial District) to an R-3 (Two Family Residential District) zoning classification. 3. That the Zoning Administrator of the City of Canton, Illinois is hereby directed to make the appropriate changes to the zoning maps of the City of Canton to reflect this re-zoning. 4. That this Ordinance shall be in full force and effect immediately upon its passage by the City Council of the City of Canton, Illinois and approval by the Mayor thereof. 2 PASSED by a majority vote of the City Council of the City of Canton, Illinois, and APPROVED by the Mayor thereof this 4th day of November, 2008, upon a roll call vote as follows: AYES: Aldermen Lewis, Strandberg, Ihnes, Nidiffer, West, Sarff, Berardi, Schenck.
