Feb. 9, 1965
Canton City Council held a regular meeting on Feb. 91 1965 in the City
Council Chamber. Mayor Cook called the meeting to order at 7:07 P. M.
Present for Roll Call: Aldermen Sebree, Howard, Wright, Duncan, Hurst,
Whitehead, Long, Ellis, Kroell, Jennings, Bender, and George. Absent:
Aldermen Skinner and Horton.
Pledge of Allegiance was followed by Prayer by Alderman Long.
Alderman George moves and Alderman Bender seconds a motion that the minutes
of the previous meeting be accepted and placed on file.
Mayor Cook called for reports of standing committees.
Mayor Cook called for reports of special committees.
Mayor Cook called for communications to the Council.
Letter from the C. B. & Q. RR. stating that an immediate inspection of the
crossing at East Locust Street and North Fourth Avenue, and the necessary
repairs will be made. Alderman George moves and Alderman Bender seconds a
motion to accept this letter and place on file. Voice vote. AYE: Unanimous.
Letter from the Crawford, Murphy & Tilly Engineering Firm addressed to the
Johnstone Construction Co, and one addressed to Mr. William Martin of the
same company, regarding the clean-up work on the streets in connection with
the sewer work being done in the City of Canton and further stating estimate
No. 6 in the amount of x$5,382.21 was being withheld until completion of
clean-up work to their satisfaction was made. Alderman George inquired when
the clean-up work would be done and moves that all roads where the sewer
work has caused damage to be repaired by the Water and Sewer Department and
paid out of the Water and Sewer Department fund. Alderman Bender informed
Alderman George that he was out of order to order the use of the bond money
for repair purposes. Alderman Hurst suggested using the reserve funds for
repair work. Alderman Bender said the Johnstone Construction Co. should do
the work. Alderman Jennings asked that the City Attorney check on the con-
tract to see if there is a penalty clause for overtime from the 180 days
stipulated in the contract. Mr. Eldon Myers, Street Superintendent, was
asked about the condition of streets and he informed the Council that there
is no "bottarn" to the streets due to the freezing and thawing, but they could
be repaired -- an estimated one hundred tons of grgvel per block, gravel
costing $1.40 per ton. Alderman Wright said the fault is with the Crawford,
Murphy & Tilly Engineering Firm and it is their responsibility to see that
repairs are made. Alderman Howard recommended that any future members of the
Council be informed of this and that if the Crawford, Murphy & Tilly Firm does
not show more concern and help on our problems, their services would not be
required. After much discussion, Alderman Hurst seconds the motion made by
Alderman George. City Attorney Senift mentioned that the ordinance pertain-
ing to the water and sewer improvements stated that the furdwas to be set
aside as a distinct fund for construction and repairs and then suggested the
Council passing a Resolution recommending a resident engineer to remain in
Canton at all times while this work is being done. Alderman Hurst withdrew
his second of motion and Alderman George withdrew his motion. Alderman Jen-
nings then moves that the City Attorney prepare a Resolution to be sent to
the Crawf ord, Murphy & Tilly Engineering Firm and request that some action
be taken before the next Council meeting on Feb. 16, 1965• Alderman Duncan
seconds this motion. Roll call vote. AYE: Unanimous.
Letter from William Vasen, 1405 Montello Court complaining of the removal of
dirt from his yard, water seeping into his basement and the fence not being
replaced after the construction work on the sewers.
"Operation 21" a bulletin from the Illinois Liquor Control Commission recom-
mending the cooperation of all law enforcing agencies in the control of sales
to or the possession of persons under 21. Mayor Cook said our present ordi-
nance is correct with the state provisions.
Mayor Cook called for unfinished business.
Alderman Bender inquired about a street condition that needed immediate attention,
Myrtle Street between Ninth and Tenth Avenue -- dirt has been pushed into the
street causing a one-way traffic condition. He then moves that the owner of

Mayor Cook called for new business. Feb. 9, 1965, Cont. (2)
Alderman Whitehead reported a water blockage on Avenue G causing flooding of
his basement. The Johnstone Construction Co. had dumped excess dirt on this
site, causing the closing of natural drainage. Alderman Jennings reported
that in the past file had been laid to a lot on Manle street. City Engineer
Howard Gihbons to investigate what can be done at this time to relieve this
situation.
Alderman Bender inquired about drainage on Ash Street near the site of the
new Y. M. C. A. -- was informed that one culvert was to be laid and
another to be cleaned as soon as weather permitted.
Estimate No. 1, Pittsburgh-Destioines Steel Co. $38,795.46 for work on the
water standpipe, approved by the Consulting Engineers and the Water and Sewer
Committee. Alderman Bender moves and Alderman Jennings seconds a motion to
pay this claim. Roll call vote. AYE: Unanimous.
Alderman Bender moves and Alderman Long seconds a motion to adjourn. Voice
