HomeMy WebLinkAboutOrdinance # 1950ORDINANCE NO. 1950 An Ordinance Repealing Sections 7(A)(2) and 7(A)(5) of Title 6, Chapter 4 of the Canton Municipal Code WHEREAS, the Legal and Ordinance Committee has determined that based on the Illinois General Assembly's 2003 amendments to the Animal Control Act that prohibits municipalities from enacting ordinances that are specific to animal breed (510 ILCS 5/24 et. seq.), it is necessary and in the best interests of the citizens of Canton, Illinois to repeal Sections 7(A)(2) and 7(A)(5) of Title 6, Chapter 4 the Canton Municipal Code, WHEREAS, the City Council has made a similar determination. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CANTON, Fulton County, Illinois, as follows: SECTION 1: Sections 7(A)(2) and 7(A)(5) are hereby repealed. SECTION 2: If any section, paragraph, subdivision, clause, sentence or provision of this Ordinance shall be adjudged by any Court of competent jurisdiction to be invalid, such judgment shall not affect, impair, invalidate or nullify the remainder thereof, which remainder shall remain and continue in full force and effect. SECTION 3: All ordinances or parts of ordinances in conflict herewith are hereby repealed to the extent of such conflict. SECTION 4: This Ordinance shall be in full force and effect upon its passage, approval and publication in pamphlet form (which publication is hereby authorized) as provided by law. PASSED by the City Council of the City of Canton, Fulton County, Illinois at a regular meeting this 21st day of October , 2008 upon a roll call vote as follows: AYES: AldeYmen Strandberg, Ihnes, Nidiffer, Glest, Sarff, Berardi, Schenck.
