W-ERFAS, Chapter 24, Section 1-3-2 of the Illinois Revised Statutes provides, in part, that any municipality is authorized to adopt by reference the provisions of any regulations or portions of any regulations, without setting forth the provisions of such regulations which are incorporated or adopted by reference are filed in the office of the City Clerk and there kept available for public use, inspection and examination; and, VM-E'REAS, Chapter 24, Section 1-3-5 of the Illinois Revised Statutes provides, in part, that any amendment which may be made to any regulations incorporated by reference by a municipality, may be likewise adopted by reference provided that the required number of amended or corrected copies are filed with the City Clerk for inspection, use and examination by the public; and, W-EAFJ~S, the Legal and Ordinance Committee has determined it is necessary, desirable and in the best interests of the City of Canton to adopt by reference certain uniform codes for the City of Canton; and, WfJiEAS, the City Council of the City of Canton, Illinois has made a similar determination. That the 1990 Edition and the 1992 Accumulative Supplement of the BOCA National Building Code, as published and sanctioned by the Building Officials & Code Administrators International, Inc., be, and the same is hereby adopted as the Building Code of the City of Canton; further, the 1990 Edition and the 1992 Accumulative Supplerent of the BOC.A National Building Code, as published and sanctioned by the Building Officials & Code Administrators International, Inc., be, and the same is hereby, adopted as the Building Code Standard of the City of Canton. 2. In accordance with contained in the BOLA National schedule shall be inserted and for Building Permits: $1.00 TO $500.00 $501.00 TO $2,000.00 $2.001.00 to $25,000.00 $25,001.00 to $50,000.00 $50,001.00 to $100,000.00 Section 114.31.1 Building Code, the hereby adopted as the $10.00 Fee Schedule following fee Fee Schedule $10.00 for the first $500.00 plus $1.50 for each additional $100.00 or fraction thereof, to and including $2,000.00. $32.50 for the first $2,000.00 plus $6.00 for each additional $1,000.00 or fraction thereof, to and including $25,000.00. $170.50 for the first $25,000.00 plus $4.50 for each additional $1,000.00 or fraction thereof, to and including $50,000.00. $283.00 for the first $50,000.00 plus $3.00 for each additional $1,000.00 or fraction thereof, to and including $100,000.00. $100,001.00 and up $433.00 for the first $100,000.00 plus $2.50 for each additional $1,000.00 or fraction thereof. 2 3. That the 1990 Edition and the 1992 Accumulative Supplement of the BOCA National Fire Prevention Code, as published and sanctioned by the the Building Officials & Code Administrators International, Inc., be, and the same is hereby adopted as the Fire Prevention Code of the City of Canton. 4. That the 1990 Edition and the 1992 Accumulative Supplement of the BOCA National Mechanical Code, as published and sanctioned by the Building Officials & Code Administrators International, Inc., be, and the same is hereby adopted as the Mechanical Code of the City of Canton. 5. That the 1990 Edition and the 1992 Accumulative Supplement of the BOLA National Property Maintenance Code as published and sanctioned by the Building Officials & Code Administrators International, Inc., be, and the same is hereby adopted as the Property Maintenance Code of the City of Canton. 6. That the 1990 Edition and the 1992 Accumulative Supplement of the BOLA National Energy Conservation Code, as published and sanctioned by the Building Officials & Code Administrators International, Inc., be, and the same is hereby adopted as the Energy Conservation Code of the City of Canton. 7. That the 1990 Edition and the 1992 Accumulative Supplement of the BOLA National Plumbing Code, as published and sanctioned by the Building Officials & Code Administrators International, Inc., be, and the same is hereby adopted as the Plumbing Code of the City of Canton; provided, however, plastic pipe, tubing and fittings for potable water piping shall be constructed in conformance with the Illinois State Plumbing Code as promulgated by the State of Illinois. 8. That variances from specific provisions of the Codes herein adopted may be permitted on appeal to the Appeals Committee appointed by the City Council should such Committee, after hearing, determine that a variance is necessary to alleviate undue hardship and will not adversely affect the health, safety, or welfare of the occupant of the applicable building or of any other person. 9. That the various Codes herein adopted and as they now exist in book or printed form are hereby declared published for the purposes of this Ordinance and shall be placed permanently on file with the City Clerk of the City of Canton and are available for public use, inspection and examination. 10. That Ordinance Number 901, being an Ordinance entitled "AN ORDINANCE ADOPTIN3 CERTAIN OODES FOR TI-~ CITY OF CANTON, ILLIIVDIS" be, and the same hereby is, repealed and declared to be, from the effective date hereof, of no force and effect. 3 ~. 11. That this Ordinance shall be in full force and effect ten (10) days after its passage by the City Council of the City of Canton, Illinois and approval by the Mayor, thereof, and publication in pamphlet form according to law.
